Arrived damaged would be an insurance claim involving whichever company it was shipped through, in this case, FedEx. Not as described would be an eBay or Paypal claim

I’m certainly not saying the OP is lying about anything but I will say that if any part of his story is not 100% the fellas on this board will sniff it out. I’ve seen it so many times over the years a poster starting a thread claiming he got cheated or whatever but not stating all the facts only to have the real story figured out by someone.
I think going with Damaged instead of Not as Described is your problem. I had an expensive card come with a cracked case and I just returned with "not as described" since the cracked case was not in the pictures. Basically immediate refund.
Not sure if others have submitted eBay claims on damaged but I can see eBay/Paypal needing some sort of value determination if you say the item was damaged vs not as described.

Yet the buyer has nothing to do with the insurance through fedex. Like literally all i could do was find out he had insurance. It is completely up to the seller to vigorously pursue his insursnce and since he won the ebay dispute he stopped caring. Leaving me with no recourse except to do chargeback.

Agreed! Time to just force the issue with the seller and do a charge back on the credit card and tell the seller, card
is coming back as not as described and make it his problem.

Which is why I had suggested send to PSA for a reholder; I had no pics and/or no idea a chunk of the card was missing. I would have probably advised to return as item not described under those circumstances, immediately. I'm still confused as why the insurance claim was denied, unless this happened after delivery was made. That is the part that makes no sense to me.

The way that this seller packaged this card is completely unacceptable. I would hope he/she is not a high volume seller who does this all the time.
I hope the seller has access to these boards and maybe learns something from this event.
I wonder if the card came to the seller in the same poor manner that it was delivered to JewVol. Or, if he/she pulled it from a pack and self subbed, did they send it to PSA in the same manner as they did to JewVol?

doesnt sound like a good dude to me either. It is always the sellers job to ensure the product gets to the buyer safely. That involves proper packaging. this is 100% on the seller in my opinion.

Members are trying to assist/give advice concerning your situation, but I guess showing us who the seller is so they don't get screwed themselves does not matter to the OP because he's a "good dude"

The point is to avoid the seller. Stupid, costly mistakes don't get glossed over just because someone is a cool dude. They clearly do not understand how to properly package a high value card. If they had packaged the card correctly this would have all been avoided. Isn't that enough?

I think if JewVol had originally filed a Not As Described claim instead of a Damaged claim, he would have gotten his refund.
