I agree 100% with a previous poster, this is on the seller. My rule of thumb is anything over $50 gets mailed in a box, but a $1700 card shipped like that, it’s just asking for trouble. You did everything you could, you paid for the item to arrive safely and in the same condition as it was in the listing, I’d call EBay again until you talk to someone with common sense (admittedly, that might take awhile) The other option that was mentioned was to contact your credit card company if it was paid for that way. How about posting the sellers ID?

He really communicated well with me throughout the process. Like I would have.
Once the claim was denied tho, he kinda stopped caring. Like fedex said they contacted the woman who gave me the package and she said it wasn't damaged. He asked me to go speak with her cause fedex was lying. She remembered me and remembers me immediately telling her the card was damaged but she couldn't state that to me in writing but would be glad to speak with the seller.
I sent him a message on ebay stating to call me. He said he was at a trade show for two days (always responded within an hour for a month leading up to the final denial by FedEx) and would call me in two days. That was a week ago. He thinks hes free and clear I guess but Im not stopping til I get my money back and I dont care who from!

nah, can't do that. just can't wrap my mind around putting one card in a spacious box. seems so impractical and i'd feel like such a spendthrift. what's sensible is saving $5 right now.........even if it means bringing $1700 into play.
The seller should be the one dealing with Fed-Ex. He is the one that paid for the insurance. Have you filed a claim with Paypal yet? Did you send the pictures to eBay? I would call them and get a supervisor involved before doing anything else. I wouldn't get your credit card company involved until I had tried everything else. eBay and Paypal doesn't like credit card companies taking money from them.
When a card arrives damaged, the seller, ebay, or paypal refuse to make you whole after repeated attempts, I'd take the charge back approach with your credit card provider.

I'd call Paypal and say "Hey, just wanted to give you a heads up, this is what's happened so far. Both the seller and eBay are trying to pork me in the bread basket so I'm going to be doing a chargeback through my credit card. I don't think it's right that you get stuck holding the bag so if there's anything I can do to help you get the money from the seller just let me know, I'd be happy to help."
My guess is Paypal will find in your favor and seek to get the money from the seller.
This has been a fascinating lesson for me as a seller making me rethink whether it’s worthwhile to ever purchase insurance (we all know the importance of proper packaging). A seller is reliant on a buyer timely noticing damage in the shipping process and pursuing the appropriate documentation at the point of receipt. Without this, the insurance claim is difficult (as we’re seeing here). While the buyer may do this, they’re not obligated for this and in fact have other recourse options (eBay return, PayPal return, CC chargeback). I’m thinking of skipping insurance going forward.
I guess the one benefit still of insurance is if the package gets lost in transit, but in that case how do you prove what was in the package?
Buying insurance through the carriers is definitely not worth it. Buying insurance for your collection that covers mail loss is possibly worth it. Not buying insurance, packing well, and using all the money that you save on not buying insurance to cover the fractional chance of loss if you do things right is definitely worth it.

I'm very surprised that ebay or PayPal didn't immediately make this right. The buyers received something that isn't what he ordered as it is damaged. This seems very simple.
I actively collect Kirby Puckett. I have collections of Michael Jordan, Emmitt Smith, Roberto Clemente, Dwight Gooden, Tom Seaver, Errict Rhett and Evan Longoria.
Tell them that the card arrived damaged, show them the first two pictures (of the card) and the third picture (with the circle). DO NOT show them any other pictures. The forth picture looks like bite marks, do not show this picture to anyone. Your claim may be declined.
Do not mention bite marks, dogs, cats, humans, teeth, etc.
This has nothing to do with PSA, FedEx or the seller. Just call PayPal. This important:

Did exactly what you suggested. The guy told me to send them an email. Sent them picks of the card I bid on and cards I received plus the one pic of the package.

If I bought a vinyl copy of Abbey Road from an eBay seller and it arrived broken would I need a letter from Apple Records or the store where it was originally purchased?

FedEx is understandable. FedEx is going to have to make an insurance payment to the seller. They need to know the lost value. EBay and PayPal don’t need it unless you were trying to get a partial refund.

I had an issue with purchasing some NFL jerseys off eBay with PayPal that turned out to be counterfeit. PayPal would only issue me a refund if I had a letter from some sort of source that they would confirm the jerseys were counterfeit and upon submitting the letter I was to destroy the jerseys instead of sending them back.
When I say F eBay and PayPal for jumping through hoops like this I really mean F them both. I wasn't going to beg someone or some company to make a letter on letterhead for me to submit so I would get a refund. I instead used my Photoshop skills to make the letter, submitted the letter and then got my damn refund. I ended up donating the jerseys and they probably got shipped to some 3rd world country.
Really make up your own letter, or quit dealing with eBay/PayPal and just start the chargeback via your credit card company who will not make you jump through these hoops.
This is just me: I'd be done with this nonsense and initiate a charge back.
Your credit card company should stand behind you on the charge back. Just make sure you have shipping confirmation that the item was sent back/received.

That picture and the one from the auction(Showing that what you got is cracked) are enough in any court of law to demonstrate it is damaged. If you have to return the item. Use USPS and have signature tracking due to the value. Put it in a well secured box. Do not use FEDEX, UPS, DHL...etc.
