silverpop, please respond to my last 7 or 8 messages regarding the 2 Mercs I bought from you but which never arrived via USPS. You're well aware that these never got here as per USPS. I've sent you all the communications I've had with them. You didn't ship these with insurance and your excuse for not doing so is lame. You will not communicate with me by either email or PM here on the forum. I saw your post about your new Morgan and at least know you're still alive.
I've done hundreds of transactions here on the BST and have NEVER had any problems, certainly nothing as remotely as screwed up as this has been with you. Many of the forum members know me and have sold coins to me, never with a problem.
For those wondering, I offered Colin $110 for 2 Mercs he listed on the BST. He agreed, wanted a check, I sent the check, it cleared and he sent the coins. Then the coins went missing with the last updates from USPS on 3/30 "out for delivery" and then on 3/31 "Alert: Awaiting delivery scan". That's the last info I've gotten. I talked to the PO 3 times early on. Their guess is the package was destroyed "due to a spill". Apparently they had a couple of liquid breakages around that time. As far as I know that might be true or the thing was stolen. Either way, Colin has the money and I have no coins.
When I asked Colin if he had insured the package his response was "no, if I had it would have been more pricey". Had he asked me I would have paid for the insurance.
I've sent him numerous inquiries both by PM here on the forum and to his email address. He hasn't responded for over a month. My guess is I'm screwed on the $110. I know this isn't his fault and neither is it mine. I wish he'd insured the package and for the life of me I can't imagine not insuring it unless as the seller I was willing to self-insure and hope for the best.
Sorry to do this here and I expect blow-back from some of you, but I'm totally frustrated with silverpop's lack of communication. Maybe he'll see this one...
^
Until the coins are delivered to YOU, it is the SELLER'S responsibility.
Insurance protects the SELLER, not YOU.
If the SELLER chooses not to insure, HE is taking the risk, not the BUYER.
In your scenario, you are owed $110 by the SELLER.

In the situation as outlined above, the seller is responsible 100% for any loss or damage during transit. Therefore, if the seller did not insure the coins with outside insurance then they insured the coins themselves. It is the seller's responsibility to get you product or a refund.
The longer I live the more convincing proofs I see of this truth, that God governs in the affairs of men. And if a sparrow cannot fall to the ground without His notice is it possible for an empire to rise without His aid? Benjamin Franklin
I have never in my life shipped a coin off without insurance. It is the seller’s responsibility to either get you those coins OR refund your money. This is not okay with me and is not the way to do business. This should be corrected by the seller, period.
The bitterness of "Poor Quality" is remembered long after the sweetness of low price is forgotten.
Under the Uniform Commercial Code, title and risk of loss does not pass to the buyer until physical delivery, unless the parties have agreed to otherwise. So unless it was addressed in the communication between parties defining when title would change hands, silverpop would retain title during transportation and thus need to make ponderit whole. At least according to Judge Judy, I am not an attorney.
When a seller makes a business decision to not insure the shipment of goods, (s)he is making the decision to self insure. Self insurance cedes the risk liability back to the seller. Thankfully for the seller, the total risk is $110.
In all transactions, communication is key. This is especially so when things go sideways. If the communication is solid, almost anything can be worked through. Once communication slows/stops, the person on the "short" end becomes concerned and frustrated - things escalate.
Communicate, and make it right.
I wish you luck, and I hope you make the right decision in the end.

Why do you, as a vendor, get to be immune from accountability due to shipment issues? If I buy an item on eBay, Amazon, or any other marketplace, the item gets delivered to me in the condition described, or I get my money back.
The coin industry is no different, and you as the seller are responsible to get the item into the buyers hands, unless otherwise agreed upon that the buyer was assuming the risk and you were rolling the dice.
I see that you you’ve chosen to throw away your reputation over a lousy $110, and it is quite unfortunate. You’re correct in saying that what happens with the mail is beyond your control. Which is why you, as the seller/sender, should have insured the package. There’s nothing unusual, new or surprising about that concept. You owe the buyer a full refund.
It’s unusual when almost everyone (or everyone) agrees about something around here. But this appears to be one such occasion.
You must not think your name and reputation are worth much, if you’re willing to let them go for $110.

This is unacceptable and totally lame on the seller's part who should be reimbursing you in full. Until tracking shows a package is delivered, it is the responsibility of the seller to make the buyer whole in the event the package doesn't arrive. Whether insurance was purchased or not is irrelevant.

This is unacceptable and totally lame on the seller's part who should be reimbursing you in full. Until tracking shows a package is delivered, it is the responsibility of the seller to make the buyer whole in the event the package doesn't arrive. Whether insurance was purchased or not is irrelevant.
