UPDATE 1st Post: I'VE BEEN SCAMMED ON EBAY!!! USPS Tracking Claims Delivered... I never got it! Wha

Delivered, July 16, 2008, 10:47 am, XXXXXXX, OH 45XXX
Arrival at Unit, July 16, 2008, 7:12 am, XXXXXXX, OH 45XXX
Processed, July 14, 2008, 9:07 pm, HOUSTON, TX 77201

This is from their website. I never got it yesterday. Also, my mail usually comes after 3 PM and NEVER before noon. To make matters worse, the package is worth a little over $500 and the seller just confirmed my thought that he didn't insure it. This could be really bad! image I need your opinions, what should I do????

Thanks in advance,
Andy

Update: Well it turns out this seller only gets dc for a reason... They then send an empty envelope to a company in whatever town you live and then it shows up as delivered on USPS tracking but, of course, I never got it and it was never sent to me. Another buyer had this happen to them as well. This is a fairly trick scam, but luckily, I paid with credit card and did a charge back and got my money back. The seller also began harassing me and such with emails. This was my first time with trouble on ebay in over 200 transactions. All I can say is ALWAYS pay with credit card because paypal doesn't really do anything. Also CAVEAT EMPTOR... I'm sticking to sellers with more than 50 feedback from now on. It was not worth the hassle or headache. Finally, the USPS now still has never lost a package of mine and my carrier will still get a gift card for christmas! Text

Check with the post office and have them can track down the carrier who "delivered" it -- it may have gone to the wrong address.

Exact same thing happened to me last month.

    Shipped June 16th
USPS said delivered June 18...I got no package.
Yesterday, July 16th, one month later to the day, I get the package. Package had been opened and resealed.

    Holy crap, was everything okay?
  • Why would anyone sending $500 in coins not get insurance? Did you pay for insurance or did he just not offer it?

He didn't offer it (I'm not crazy lol, if he had it as optional, I would have bought it). I thought it was included because shipping was $12.60 and it was just a little PCGS coin.

Yup the item was in great shape. I ended up buying the item from another source and having it shipped to my work after two weeks of not recieving the original one. As of yesterday I've now got two of the item.

How about paypal using a credit card.

I hope it doesn't come to this, but is it ethical to make a claim when I'm 100% sure he shipped it... if I won, he would be out the coin and the $$.
  • I paid for some palladium with paypal/cc that I have not received yet. Seller did offer insurance I accidentally forgot to click on it when checking out. If it never arrives is it morally wrong of me to do a CC chargeback to get my money back or should I just accept the $385 loss and take it as lesson learned? (I used the microsoft live discount which is why the palladium was only $385 for an ounce) Seller did state in auction that it's not his responsibility once it leaves his home, but as far as I know I could definitely get my money back anyways regardless.... sellers should always insure items to protect themselves. In my experience, sellers are ALWAYS responsible to make sure item arrives, period. They are the ones that have to file the insurance claims, not the buyers.

EDIT: It arrived, uninsured. Problem averted.

The fault lies with the post office. Since the post office claims it was delivered they are, conveniently, covered. There is zero you can do in this situation. You're screwed. Get pissed and get over it cause that's just how it is.

Correct me if I'm wrong but is it not the responsibility of the seller to make sure you get what you bought? He should have used signature confirmation so that it would not get delivered unless you were there to sign for it.
  • i didnt think you were crazy. I would believe anyone spending money on coins would opt for insurance, I too would have assumed that shipping at $12 and change, insurance would be cover.

For Paypal seller protection the require Siggy Conf for items over $250. So to satisfy Paypal, the seller would need to provide a Siggy from you.
It is not exactly cheating, I prefer to consider it creative problem solving!!!

  • I had this happen before, too. The tracking claimed the package was delivered, but I never got it. I went down to the Post Office and they had it back in the back room.

I called, they claim they don't have it and the lady said she would call me if they found it.
  • This happened to me before, not with coins but with a GameBoy Console. I never received the package and USPS tracking says it was delivered. Filed a dispute with Paypal but the seller won as he was able to provide the tracking # that said delivered. I'm sure it was delivered elsewhere but they probably didn't want to return it once they saw what it was. So I lost $80.

    Hope you'll get your package.

Correct, the seller did not follow Paypal rules, and the seller should have insured it anyway. If the coin cannot be found, the seller should eat the loss, because it was he who decided to gamble and not insure it, not you.

Hopefully the coin will turn up from the PO, but if not, the seller owes you a refund, and you can file a Paypal claim if the seller refuses.

Track down the mail carrier. Ask him where he delivered the package.

PayPal WILL refund the money to the buyer, if it comes to that.

The seller is probably a fine fellow, who failed to read the PayPal TOS/UA.

The seller loses, if the item cannot be located.

The notion that DC/SigCON packages obviate an insurance claim, when
USPS insurance has been purchased, is false. I have filed many claims
over the years on lost DC/SC items; the PO knows that mistakes happen
and carriers put stuff in the wrong box. The USPS, upon affidavit of the
claimant and investigation, DOES pay such insurance claims.

The seller is responsible for insuring the package. It should be his loss, not yours. Take the appropriate actions to insure that YOU don't take the loss.

This happened to me once, as the seller.

It turned out the buyer lived in apartments and he talked to the delivery person, who said he gave it to the front office. The buyer went to the apartments front office and the package was there.

That's where I would start, talk to the delivery person. They will know if they delivered the package.

This is why a signature is needed. Mailboxes are not a secure place and anyone can open it and take whatever is in it out.
If the po dosent find it or a family member got the mail and didnt tell you then the seller gambled and lost to save a few dollars.

I just talked to my carrier, he never had the package yesterday!?!?!?

I had a buyer have the same thing happen to them. I offered to send them a second coin for free (which I did via registered and they received). If your seller is good, he will step up to the plate and pony up. It's his responsibility to get the coins to you.

In a funny twist to my buyer's situation, about a month latter, the 1st package turned up. It was not opened. Near as we can tell, the USPS delivered the package to the wrong address. The people at the wrong address were not home (having moved back north for the summer) and when they arrived at their vacation home and received the wrong package, they just dropped it back in the mail. The USPS eventually delivered it to the correct address (my buyer's address).

It all worked out for the best. I was just out a few bucks for shipping the 2nd package. I even got positive feedback out of the deal.

Well, someone scanned it as delivered -- you need to find out (via the P.O.) who scanned it.

I think what you meant is that he is responsible for delivering it. Whether he insures it or not is up to him. --Jerry

That's his problem Andy...With that kind of shipping charge he should have covered himself to be safe.

You guys just don't get it. USPS insurance is ridiculously expensive. If you do a good job packaging, labeling and addressing (with barcodes) and every time you think about insuring a package instead you put 50% of the insurance fee in an envelope marked "petty cash for losses" that envelope will grow and grow. Use it to pay out losses and in the long term you'll come out ahead. $500 is no big deal to a large volume dealer. I spend more than than on shipping in a good month (and I'm a little guy). I have a loss every couple of years. I self insure every package that the buyer doesn't want to pay insurance on. If you buy a coin from me, don't insure it and it gets lost do you expect me to replace it? I do. And I do it out of my pocket. An added benefit is that I never have to fill out an insurance claim form. I hear that's no fun to try to collect--not a problem for me.

Don't feel sorry for the seller. that's just a cost of doing business.

No kidding. I'm still waiting for reimbursement from the USPS for a package lost in March. I'm not real hopeful at this point, since I can't seem to find anybody at the post office who can tell me what's going on. The buyer's already gotten his money back from me, though. I guess that makes me one of those unethical self insurers that everybody screams about, doesn't it? image

Well...if it were me.....I would take my fat rear down to the PO, along with MY CARRIER and have HIM inform the Postmaster of your PO that he DID NOT DELIVER the package....and then I would look at him (Postmaster) and tell him to please find the package within 24 hours, if not...you will inform the Postal Inspector and the local news station that does "ON YOUR SIDE" coverage.....this will work...I've done it

No Postmaster wants his name and Post Office location on the local news. imageimage

In my area...we have a local news channel (Channel 12) that helps local people with things like this when they feel like they have been wronged by a business....they call it "12 On Your Side"...it has done wonders for many people....and sometimes just the threat of contacting them (the news) will get people to do what they are SUPPOSED to do!

    RAH
  • The seller is responsible for all items he ships to customers, and buy purchasing insurance, the seller and buyer can cover themselves in case they don't do their job. No signature is required for any amount unless you state the value at $300 (Could be $250 now) or more when you purchase insurance.

This seller is responsible, but paypal will side with the seller as long as he gives them proof of delivery with the tracking number. I know because I sent coins, that where delivered, but to the wrong person. I worked with this buyer for a month, and told him I would send a replacement as soon as I got it in stock. It was only $12.00. So as I'm waiting, but didn't have to wait or promise a replacement, he filed a complaint to paypal. Paypal ruled in my favor, so then the buyer gave me a neg on ebay. It's the only neg I have ever received.

Now, I would ask the seller to refund half of the payment you sent via paypal, and that when you receive the coin, then you will send it back. I doubt he will agree, but I would try to do this before it gets ugly and so your not out the entire $500. He can't leave you a neg so you also have that in your arsenal.
