When eBay says "by bidding you are agreeing to a binding contract" how is that different than me putting a bumper sticker on my car that says "Get within fifty feet of my car and I am not liable for any damages to your person or property." Just because you SAY or disclaim something doesn't make it true. Have any test cases come up? What do the courts say? I know that software EULAs are no enforceable, and I imagine that auction site messages aren't either.

After scanning rare coins on Ebay, I noticed that you had bidded on the "Colorado Penny." I just wanted to let you know that I have the Indiana penny on Ebay as well. Unlike the Colorado penny, my penny has not been buffed or clean to appear a different color. I do not know how rare these coins are as mine has been in circulation and does have some wear on it. Clearly, you can see on my penny it has not been in a press since manufacture. Look for yourself at my auction:

I couldn't be more happy that eBay is not requiring me to complete the transaction that I was not high bidder on nor bid to the reserve on. So, uhm, why in the world did eBay remove the listing a week after the auction ended? I've never seen such a thing.
