    When eBay says "by bidding you are agreeing to a binding contract" how is that different than me putting a bumper sticker on my car that says "Get within fifty feet of my car and I am not liable for any damages to your person or property." Just because you SAY or disclaim something doesn't make it true. Have any test cases come up? What do the courts say? I know that software EULAs are no enforceable, and I imagine that auction site messages aren't either.

    In the meantime you'd have to pay a $62,500 final value fee and would probably have to spend $10,000-$20,000 in legal expenses on a very dubious case against someone who's probably too broke to pay any judgement against them anyway...but hey, if that floats your boat!

    I just received this message via Ebay contact a member...

    After scanning rare coins on Ebay, I noticed that you had bidded on the "Colorado Penny." I just wanted to let you know that I have the Indiana penny on Ebay as well. Unlike the Colorado penny, my penny has not been buffed or clean to appear a different color. I do not know how rare these coins are as mine has been in circulation and does have some wear on it. Clearly, you can see on my penny it has not been in a press since manufacture. Look for yourself at my auction:

    Anyone know how much it cost him to create an auction with a $500 start?

    I'm getting closer and closer to wanting to bid to win the Colorado penny, just to get that sellers credit card charged for the Final Value Fees. First time I've ever wished I was a scammer and had hacked someone else's account to use so that I wouldn't screw up my own.

    I'd just let it ride and not trip the reserve--with 9 hours to go and the high bid at almost $3.6 mil the seller is probably becoming incontinent.

    Sorry--you're right it's not at 3.6 yet--it's currently at $3, 500, 591.96 with a total of 6 bids.

    Arent you guys forgetting that there is a NPB (non-paying bidder) process to have the final value fee and listing fees refunded?

    Then again.. the seller (being a 0 feedback) probably wouldnt know that.

    I couldn't be more happy that eBay is not requiring me to complete the transaction that I was not high bidder on nor bid to the reserve on. So, uhm, why in the world did eBay remove the listing a week after the auction ended? I've never seen such a thing.
