Scratches in right obv field suggest MS 63 but hair detail seems weak. Just the picture?

From what I can see it's a beautiful coin with great luster and color and pre slabbing days I'd buy if price were right. I can show you 4-5 very similar and they graded 62 (still have them) which I thought was on the low side then.
I think you get a 63 easily enough and probably get a sticker but the marks on the right field and the fact there're on the obverse makes it very hard to get a 4. TPG don't seem to accept visible marks on small coins pass 63.
In today's world - MS 64
It looks to have beautiful, rolling luster and great color. Perhaps the MS62 grade was given due to what appear to be hairlines behind the portrait?

Boy, definitely under graded.
I always like the type ones. They look like tiny twenties......
It has hairlines, but VERY minute. Very few bag marks, too.
It's undergraded no doubt.
I like her though and she was very reasonably priced given the 62 grade and getting her back of greysheet bid!

The strike appears to be a little weak for a Type 1, so I'm going with MS-63. I think it would make MS-63 today.
If you want to compare notes, this 1850 gold dollar is graded MS-62.
my first thought when i saw the photos was au58. sorry. it's hard to grade from photos. especially gold. cool coin though!

The trouble is the photo does not show the hair detail over her forehead and behind the ear. On a Philadelphia Mint coin that is usually strong. This one is weak in the date area and corresponding areas of the obverse.
Strike on these is probably less important than luster and marks. In that regards the 1849 looks 1-2 points nicer than the 1850 with better luster and far fewer marks. I would have guessed the rattler grade was 62 or 63.
this is my favorite type.
