eBay payment terms vs my terms - ALL SET, GOT MY ANSWER

Background: I sold a card on Sunday night and I have a three-day payment policy. So, according to "my" payment terms set forth in the auction, as of this morning, an unpaid item is late, right? Payment was due by Wednesday evening.
So I sent a buyer a message that said, "Hello and thanks again for your purchase. The auction payment terms stated that payment must be recieved within three days of auction end and I dont see a payment from you as of this morning. Can you please advise when you'll be sending the paypal payment? Thanks so much :-)"
His response, "How dare you try to get around eBay's seven day payment policy. You, my friend, do not dictate how long I have to pay, eBay does! I just sent you your payment, buy I'm letting eBay know about your violation of their payment terms."
So... my question... I know I cant file a NPB until after seven days, that makes sense, but arent I allowed to set my own payment terms? Am I breaking some eBay policy?
Thanks guys.

I don't know that there's any specific eBay policy that prohibits you from stating in your lisitngs that you have a 3-day payment policy, but because you have to wait 7 days to file a dispute, it's virtually unenforceable... On top of that, you're going to discourage potential bidders and, like in this case, tick off winning bidders who didn't realize you had a payment policy so outside the norm.
You're always going to have at least occasional problems because of it. The best thing you can do would be to change to a 7-day payemnt policy.
And this sounds very familiar. Didn't you have a thread a couple months ago about the very same problem?
Does anyone have something useful to add to this?
Thanks!
Loves me some shiny!
we are talking about baseball cards here.
three days is not enough time.
vacations, holiday weekends, people away on business, etc.
quite frankly, when i get afriendly reminder right away, they go to the bottom of the pile to get paid.

Hey Bryon, The thread a couple months ago was when I had a 24 hour policy. I've since changed it to three days because the general concensus was that 24 hours was unrealistic.
And, outside of it being unenforcable, am I somehow breaking an eBay rule by asking for it within three days? I just want to make sure that if this guys really "reports" me, that I'm not breaking some policy I'd never heard of.
<< <i>nightcrawler, is sending a friendly reminder to a late-payer "antagonizing" ???

No such thing as a friendly reminder when you're the one recieving it, especially after three days.
And that is something useful, although I don't expect you to get it.
Your disgruntled buyer would agree with me.
My guess is that you're not breaking a rule, but you should just contact eBay and ask them. You're much more likely to get a definitive answer there than here.

So you pay your car payment late and your creditor calls you, that's antagonizing? Bottom line is you owe money, your opinion is irrelevant.

Thanks Bryon, it seems that everyone on here just wants to insult me rather than actually adding something useful to the topic anyways.
Take it easy my friend.
Also, do you accept checks and or MO? If so how do you expect payment within 72 hrs?
According to your policy payment was not due until this evening, why would you send a reminder before tomorrow morning?
If you can't file a NPB until after 7 days has elapsed why even bother sending out a reminder?
I have no idea as to your question that is why I suggest you use live chat or help.
Steve

Perhaps I'll try that, thankyou Steve.
No, I do not accept checks or MO. That's also clearly stated in the auction, it's PP only.
You have an excellent point, it's not due till tonight, honestly I missed that. Thank you.
Why bother? Because the bottom line is they're late. Am I the only person on here that actually reads payment terms and adheres to them?
Thanks again for your suggestion Steve, I'll give that a try on my lunch or something.
Have a good day.
IMO you seem to ask for permission to do anything, can;t seem to do anything on your own.
He probably added the hrs up and figured he had till tonite.
Maybe, wait the next time until the 73rd hr?
Steve
<< <i>3 days and its only Wednesday AM, payment isn't due until Wednesday PM. what's to say you won't receive it today? Also do your auctions indicate PayPal payment only? As I already stated, I made a mistake and the payment is not actually due till tonight. Did you see that?
And thanks for your opinion that my payment terms are unrealistic. Not only has that already been stated, but is irrelevant to this conversation. And What exactly did I ask permission for? Did you even read the original post?
<< <i>I'm thinking the buyer did read and understood your policy. He probably added the hrs up and figured he had till tonite. Maybe, wait the next time until the 73rd hr? Steve >>
I totally agree Steve. As mentioned above, I made a mistake. I was thinking, for some reason, that they had till last night, not tonight. So now I can see why he might be ticked off. I wonder if he even noticed that since he was thinking he got a week anyways? I know know.
Thanks again for your insight on this Steve, very helpful.
as seller can set a specific time period in order to be paid. Like mentioned, you can't file a NPB until 7 days has elapsed
anyway.
Steve

I don't think he saw it. You both posted at the same time.

I would have been highly upset as well since you were telling him it was past your 3 day period even though it was not. I have a 5 day period in my listings, I send an invoice on day 5 I send another invoice and then I file on day 7. I never send an email demanding payment as that is more likely to get no payment. Its not worth the fight if it does not sell relist and move on.
I got a feeling after May your feedback is going to take a severe hit if you don't learn how to communicate with your buyers in a less confrontational way.
However, if your policy and Ebay's policy differ, then Ebay's policy wins, since you're playing on Ebay's field.
Lets say you put a sign on your front door that says:
"Knocking on this door will be considered an agreement to the following terms:
1)you are giving the resident ownership of your pants, and will allow the resident to remove them from your body
2)any protests or resisance on your part will be play-acting for the enjoyment of the resident."
If the local Girl Scout comes knocking on your door to sell cookies, and you attempt to enforce the wording on your sign, you will still go to jail, regardless of what your sign says.

You posted that at 7:53am on Wednesday. Then later you said you thought it was due Tuesday night, thus the Wednesday morning reminder.
Which one is it?
My suggestion would be to take your Xanax and stop worrying so much about ridiculous payment deadlines.
Oh, and as for your car payment comparison, my lender doesn't set unreasonable 3 day billing deadlines. No comparison there, so please don't try it.

Ruth explained that I'm allowed to request the money in three days. So that answers my originial question. She also added that it is technically unenforcable since I cant file a NPB till after 7 days.
So what I'm going to do is use 7 days on all my auctions moving forward and not contact them till the 8th day. If this is "antagonizing" them (even after a week) then so be it. A week is adequate time to pay for an auction.

Hi Alan! I hope you're doing fine. How may I help you?
9:50:53 AM baileypsa10
I'm great, thanks. My question is this: As a seller, am I allowed to request whatever payment terms I choose? For instance, I normally say POaypal required within three days. I had a buyer tell me that I was violating eBay policy because eBay allows seven days on all auctions. I know I cant file a NPB till after 7 days, but I'm technically "allowed" to ask for payment in three days, right? I just want to makse sure I'm not breaking some policy. Thanks!
9:51:29 AM Ruth
I am more than happy to help you with that.
9:51:39 AM Ruth
Yes, you can actually do that. I mean indicate that in your listing.
9:52:10 AM Ruth
But it is also correct that sellers are given seven days after the listing ends to file the Unpaid Item dispute process.
9:52:14 AM baileypsa10
So, the buyer eas incorrect in stating that eBay allows seven days on all auctions?
9:53:09 AM Ruth
Technically, the buyers are given 7 days to pay for the item. That would be because sellers can only file the dispute 7 days after the auction ends.
9:53:44 AM baileypsa10
Super, thanks for your help.
9:54:04 AM Ruth
You are very welcome. No worries at all!
9:54:04 AM Ruth
Is there anything else I may help you with?
9:54:11 AM baileypsa10
Nope, all set, thanks again!
I seriously believe you should lighten up, give them 3 days on top of the 3 days before you send the ol friendly reminder.
What's wrong with ebays policy? Why does it have to be paid in three days (24hrs... what the???).
Relax guy, have a better rest of your day.
Sincerely, Trent
Edited to add: In 10 years on eBay I have never put a set time for payment in my auctions. If payment has not be received two weeks after the auctions ends, I send an email. One week after that if payment still has not been received, I file a NPB. That formula, while maybe not for everyoen, works perfectly for me.
Day one: Invoice
Day Five: Second Invoice not other contact.
Day 7: File UPI let Ebay deal with it
Day 14 or sooner if they reply and try to string me along. Close UPI give them a strike relist and move on.
Its just Ebay either the buyer will pay you or not no use getting all stressed out about it.
Boopotts: If I get all payments withing a certain amount of time, I can make one trip to the PO instead of buyer #1 payong on day one and buyer #2 paying on day 14.
Leiascards: I agree. As I stated (now twice) I made a mistake and thought last night was the deadline, when in fact, it's tonight. I'd be mad at the seller (me) too.
digicat: I agree... why wait the full week? (shrug)
gumbyfan: This has already been established. Your Xanax comment was unnecessary also.
WinPitcher: It was an $80.00 sale. I can give you the link if you'd like it.
justmichael: The "immediate payment" rule will get you less buyers I think. Allowing some time (even if it's three days) gives them some extra time.
Leiascards: See my comment to justmichael.
<< <i>gumbyfan: This has already been established. Your Xanax comment was unnecessary also. >>
I disagree. What had been established is that you said in your original post that payment was due tonight, yet you told the buyer he was late this morning. Then you said that oops, I thought payment was due last night (although you stated in your original post that payment was due tonight). Those things have been established, yet you want to ignore the fact that you knew, up front, that payment was due Wednesday night and still you harassed the buyer on Wednesday morning.
If you're that hard up for $80, send me your paypal address. I can loan you the money.
But you'll have to pay me back within 3 days. (I'll contact you in 2 to tell you you're late)
Oh...and my Xanax comment was both necessary and suggested. If you need a prescription, talk to your shrink.

Alan,
I do have to say, you sure do know how to work this BB up with some of the stuff you post.....
thanks for the entertainment..
I only accept Paypal myself anymore and do have the block set up though.
Shipping: Is $7.00 via USPS. Insurance, delivery confirmation, etc is optional and is highly recommended. I cannot be responsible for uninsured/unconfirmed items. I’m a regular guy with a full time job, so I don’t go to the post office every day. Please allow 7-10 business days for receipt of your item(s).
But you expect 3 day payment. And will ship when you have time.
I hope you are not serious about that comment either. Those are both for your protection as if you take Paypal you are responsible for getting the item to the buyer.
Steve
Check your facts before you try to make me look bad. Thanks
So this is the same guy you have already had a run-in with earlier?

Thanks, I was unaware. And no, different guy.
Thanks again.
<< <i>An even further "check" of my closed auctions would show you that THIS and THIS combined, with shipping, is the aforementioned $80.00 transaction I spoke of. And the one that went for $2.82 was a lot of nine graded cards.
Check your facts before you try to make me look bad. Thanks >>
Wait a second. I thought that buyer backed out because you tricked him into thinking he was getting the nunchuks.
Link to the Drama, Act One.
on Sunday night you had a thread in which you stated that the buyer emailed you and said he thought he was getting more then just one remote.
Why then would you send him a payment reminder?

I sold THIS and THIS a couple hours ago.
I just got home from Easter DInner with the Fam (Happy Easter to everyone, by the way) and I get a note in my eBay messages that says, "Dear baileypsa10, I did not realize you are not including the nunchuck, the remote alone is no good without it. I would like to withdraw my bid."
Now if this moron actually read my description, he wouldnt have run into this problem.
My question: Neg him? Or just relist and eat the fees? I hate morons like this and I want to neg him, but I know he'll just neg me right back.
And before my two favoite clown on here decide to jump all over me for this, yes, I know I used one photo for multiple auctions (just like 4SC does with their cards) but you've got to be a brain-dead moron to think that this included a nunchuk.
Thanks for any advice you guys can give

Again....Alan tells a story and tries to convince the world that 2 + 2 = 7.
But everyone telling him the answer is 4 gets told they're wrong.
Alan's stories never seem to add up in real life...but I will say they're highly entertaining!
