I have done nearly the same thing the seller has done, without the snide remarks. I too am busy and selling chit on eBay is a side thing in order for me to get more stuff I want. But, when I have overlooked that it had been some time(3weeks, maybe more, maybe less) and the guy marks it as sent. I will immediately file the NPB. I don't know many of the buyers and if it is a first or even 2nd transaction, I file it because I think they might be buying some time and not actually sending payment. I typically will file NPB within 10-14 days if I have not gotten a response to my initial or 3 day reminder invoice.
I do not understand why he wouldn't send you the card once he got the payment. I will close an NPB the minute a payment is recieved and promtly send out the card. That part of this transaction is fishy, but I think by you sending a "Payment Sent" to him was a reminder that he hadn't gotten paid.

Which indicates to me that he wasn't concerned about it until he saw he was going to have to sell it at that price. It seems very much as if he was "laying low" and hoping you would forget about it, so he could resell it.
IMHO, take the check back, and eat the transaction. You screwed up (maybe), he screwed up (maybe). Just call it a wash. If you're unhappy with it, don't buy from him again.

Not to be harsh on you but it should end right there. Everything else you posted are excuses; nothing more, nothing less.
If you bid on an item, it is your responsibility to live up to your side of the deal in a timely matter. In this situation, Ted, you didn't. Not responding to a Seller's email or even making contact for almost a month is wrong. Had you paid for auction, just like you did with others, this would have never happened.
Lesson learned and move on..

After rading the posts, I agree I was wrong, maybe he was wrong, who really cares. The reason i went "All the way to the bank" is to make it EASIER for the seller.(haha why would I do that, who cares anyways) Since it had already been SOOOOO long, I figured what is a few more days, send him the bank check (which is 6 dollars) and make him happy. Well, I guess it didn't work. i was actually wondering where the heck the card was when I realized I hadn't paid... D'OH! Thanks guys for helping me out and letting me vent, even if it was just a little SIDE with me since I am good and you like me...would have been a great arguement, but I am always up for debate! Ted knows he was wrong, I really dont think he needs this shoved in his face any longer. Everyone is entitled to an occassional brain fart. In fact, I think it would be safe to say that everyone has had one at some point in their life.
On the opposite end I had a buyer pay by Pay Pal on an auction for over $300 that ended on a Thursday, I sent the cards UPS next day on the following Monday. By the time I got home he had already pulled his payment out of Pay Pal and accused me of not sending on time. Both Ebay and Pay Pal sided with him and I had to give him his money back. His reason was that he was going to a show on Sat and wanted to flip them and since he paid by Pay Pal on Thursday I should of sent them that day. I still can't believe that Pay Pal agreed that if a buyer is unhappy for any reason they get their money back.

Funny how it can get out of hand when two seemingly reasonable people see things in a different way. Something factual, but damning: I'm thinking along the lines of:
"paid by paypal. One email 3 weeks later promised to send. No email since, and no item either."
without saying "thief" etc., that excites people into neging back - even tho that's 'zactly the case, in my case.
