So I purchased an item and now the seller won't ship...what to do.
I purchased a rather nice jewelry and coin scale via auction on ebay. I thought I got it rather cheap and won the auction. The next day the seller refunds my money and then lets me know that he accidently posted it for sale and that he had already sold the last one.
BIG LIE, tonight I look for the same scale and what do you know.... he has the same one listed again.
Is there any recourse?

In all my years on ebay this has never happened to me so I wonder how so many have experience with this. Or are people just repeating what they have heard?
I would give ebay a chance to pressure the seller into making it right. Since he has the item relisted, ebay should have no qualms in telling him to honor the deal. And trust me, as a seller, I know that ebay can put enough pressure on him to make it right.--jerry

Make sure you note in the neg that the item was relisted in order to blunt at least one of the lies they can attempt in their followup.

I remember about 10 years ago, I won a coin off ebay that I had to really fight for with another bidder. I recieve the item with a printout of the auction page and the price circled. I'm not sure how dense this seller was but on the page he printed off, right there literally in black and white (ink) was the line "You Have Been Outbid". I thought about it for a second and realized I caught this scumbag in a shill. Cheapest coin I ever got off ebay.
Yes it is a no brainer neg. Just makes me sick that they can't follow through with a binding agreement. I didn't even have time to respond to his email before he immediately refunded my money and told me that he didn't have any more in stock.

I would just move on, while it suxs sometimes you run across sellers like that. IMO you run across more issues when dealing with BST board and craiglist over ebay listings.
Neg him if it makes you feel better, nowdays you do not have to worry about a seller leaving you a neg. Personally i does not bother me to buy from a seller with a few negs that has done over 750 tranactions. You are bound to end with with a few unhappy campers if you do it enough.

No. But then, the seller didn't steal the money, did he? The buyer sent the money to him voluntarily, and the seller returned it.

An ebay win is a binding contract with seller. Payment was made promptly. Delivery was not.
Also, it looks like you have to wait 7 days to file NEG feedback now a days. I will have to do it monday morning.

I've had this sort of thing happen twice in the past 10 years. When all is said and done, all you can do is neg and move on. Surprised about Provident, though. Thought they were better than that. But then again, I said the same thing about APMEX not too long ago.

I've ordered coins from dealers and the smart ones abbreviate "coins" or just drop the word entirely. For example, "Liberty" on their return address rather than "Liberty Rare Coins". Why not just send it to you by addressing it to your personal name rather that your company name? Sounds like a lame excuse on the part of the seller to not go through with a transaction.

Suppose the buyer misses an opportunity to purchase a different item because the seller is currently holding the payment, and the buyer expects to receive the one he already purchased. When the funds are later refunded, the buyer doesn't get to rewind and have an opportunity to purchase the similar items that have already closed.
