    Definitely report him.
He is either totally clueless or a crook...even just by reading his description.

Since he says right in his description that the picture isn't his, it should be removed, I would hope, quickly by ebay.

I've been told I tolerate fools poorly...that may explain things if I have a problem with you. Current ebay items - Nothing at the moment

Todd and I both just reported him. Let's see how long Ebay takes to remove the listing.

  • very nice toned indian head 1903 the picture shown is not the one you receive the difference between the the two are very minor the one im SELLING has a little more wear as in mine does not have a readable liberty on it on the crown of his head has few scathes

Minor difference? The coin he is selling is a 1903, the picture is a 1901, lol!

Look at his feedback....either mentally not all there when it comes to thinking things through, or a crook trying to build up feedback and not being smart enough to even do crookedness correctly:

    ok
not at all what was described in ad. you don't get the one in the picture!!
ad said mint, very fine on reverse, fine on obverse at best, and taped down
Dissapointed the coin received was not the one pictured.
Refund made without problem - thanks

Those are all warning flags and tells me the items are deceptive at a min.

When you report the auction make certain that you tell ebay that you not only own the coin and image, but that you have not given your consent to the use of either.

I sent the loser an Ebay message telling him he stole my photo and that I had reported him to Ebay. Here's his response:

Loser: "i got thiss off of google images"

Then I sent him this message:

Me: "It's not even the same year as the coin you are "selling" you big loser!"

Loser: "well i cant take a pitucre off this coin because i dont get the right lighting to show the toned part off it because im not rich and dont afford expensive cmaeras and id didnt steal your picture if it is posted on google images because therefore you post it to the world and any one can use it under law and im not a big loser for trying my best this is so stupid of you to say that"

I asked the seller why he posts a pic of a coin that is not up for auction, and not similar to the one offered.
    His response:

lol wow i have posted number of coins with photos from yahoo, search, google serch,ask.com and now everyone body makes a big deal out this? i've been doing this since aug 15th

He is an idiot, he is basically saying as long as it is on google images, it is okay to take it and use it as your own. He is crazy.

  • Just messaged him myself;

I believe I've seen that coin before. It was on a good friend of mine's website. Please do not use photos that you do not actually have the rights to, as you are tricking people, that look at your auction. If you can't take photos of your coin, then don't include photos.

did you opt out of the generic photo deal that ebay has? I didn't so people are now free to use mine if they are in the generic photo pile (whatever they call it) But mine all have "Carlsbad Eagle Trader"on them so if he uses my photo he is advertising for me. --Jerry

OK. So I Use google images quite a bit to look things up and it just has basicly links to websites. So to say he got it from google images is just saying, "I found your website through google images and got it there." --Jerry

per his current listing "the picture shown is not the one you receive the difference between the the two are very minor the one im SELLING has a little more wear as in mine does not have a readable liberty on it on the crown of his head has few scathes nice addition for a collection re-sell."

I do believe ebay will only pull listing only if photo or description has been lifted from an earlier ebay listing. Since this is not the case, good chance there is no ebay violation. Unethical? YES.

looks like he updated listing with his own photo. You'd be surprised at how many sellers to not know it is against ebay policy to use other seller's photos. Unfortunately, when ebay pulls a seller's listing for such reasons, ebay is not very clear to the seller on why the listing was pulled.

I have had a lot of seller's lift my photos and most of them (when politely emailed) apologized and removed my photo. What really pizzes me off is when a seller will use my active photo to undercut my BIN price while my listing is active.

Ocho, I appreciate your reminding us to be more professional, and I know you are correct in that I personally could have been a little more "high road" in my comments to the seller, which I initially was. And yes, I was frustrated that he was ignoring my request to remove my photo, so by calling him a loser I was hoping to get his attention - sure it was juvenile and probably unnecessary, but to be honest, I felt a little better knowing it got his attention (even though it took all the pressure from this forum to finally get him to remove the photo).

And sometimes people like this need a little knuckle thwacking to get their attention, especially people who try to get away with scamming or taking advantage of others like this guy has admittedly been doing. So if any of you feel I shouldn't have stooped to calling him a loser, I understand, but I don't feel my comment really necessitates any more "shame on you" finger-wagging - at me or Tmoney.

Nothing to be ashamed of my friend. You don't take what isn't yours, and if it takes a YN to teach you that listen, you are one sick person. You and I both know that seller knew what he was doing, why should I have sympathy for him, or be nice? He is a scammer plain and simple. My age has nothing to do with what I said, if you can't handle the truth, tough. Your feelings hurt, tough. The guy had a motive of at least scamming somebody or getting a couple high bids at the end, by snipers. I messaged him, reported his auction, and gave my opinions here, you don't agree with my opinion, or don't like what I said, or feel you need to discuss it further with me, please PM me.

    Oh My!

No one mentioned an obsession but threatening to "rip him apart" hardly seems like something a 14 years old would be capable of accomplishing other than continuing to extoll your grievance against him for responding to your query with a "Smart ass" or stupid answer. Therefore, you must have been mimicking (i.e. imitating) some of the "tough guy" attitudes which occasionally get displayed here on the forums.

Yes. Those Big Boys. You know, the ones with the "super human typing fingers" capable of reaching through computer moniters to "rip him apart"?
