Ebay seller lifts MY photo then apologizes for how "crappy" it is!!!

Here is a current auction on ebay:

Here is a coin that I photographed and sold last week:

Notice any resemblence? I emailed the seller and said "Its nice you liked MY photo enough to steal it without my permission, but it would have been nice if you had asked first". What else can/should I do if anything? Should I just consider this to be flattery and ,let it go, or have the auction nuked?

    At the bottom of this persons listing, you will find a link called "Report this item".

    Reason: "Copying of your listing"

    Detailed Reason: "Someone copied text or pictures from another eBay user"

    In my opinion, if the coin is purchased, so goes the photo.

    After all the seller should be happy that someone bought their coin
    and since you want to please your customer, I think it's OK in that circumstance.

    Legally, the photo is still yours, but I would not care myself.

    I'll second that. Not a power screwer, so eBay might take action. His star score is dangerously close to being banned from selling, too.

    File a report with ebay and send him an email stating that you are going to sue the pants off of him image

    If eBay acts in time, they will pull his listing.

    I sent him an email:

    Hi,
    This coin looks a lot like another I was bidding on about a week ago, are you the original owner of the coin and is that a picture of the exact coin for sale? Thanks, I look forward to bidding (I did not win the last one).

    It is unfortunate that they submitted your picture in such a way that you cannot change it.

    I host my pictures from my website. If someone was stupid enough to link to one of my pictures from my website in their auction (and I knew it), I would have some fun at their expense.

    did he right click the mouse and capture the photo that way or is he direct linking it from your photobucket (or other) account??


    if its the latter then you can have some real fun here......just switch the photos on him

    I did that once. Had the buyer offering free shipping and a year's supply of Oxy Clean as an apology for stealing a photo.

    He/she/it hasnt gotten back to me yet. Regardless of an apology, I have reported it as a violation. Like I said, it was no big deal really until I read his description about the "crappy picture". Damn that stings!

  • Here is the photo....not my very best effort to be sure, but "crappy" IS kinda harsh. Especially when the guy who steals it, then uses it then apologizes for how bad the photo is.

    I've been told I tolerate fools poorly...that may explain things if I have a problem with you. Current ebay items - Nothing at the moment

    Apparently ebay has forced him to post a different photo. My best guess is that its another "lift job". He went from my "crappy" photo to a "super crappy" photo. He also accuses me and several others of trying to sabotage his auction. We all need to get lives and jobs according to him!

    On a side note, the coin he is selling is not a 15th anniversarry panda. It is a standard 1996 issue. There were a limited amount of anniversarry coins made this year, but his is not one of them.
