What to do ???? Threatening e-mail over non-delivery

Back in January, I bid on and won a $300+ coin from a Canadian ebay seller........... The coin was never delivered........ I contacted Paypal, and eventually got my money returned........... Today I get this e-mail from the seller......

<< <i>I think 48 hours to resond to this email is enough time, so that is how long I will wait. The money or the coin. It's one or the other. You seem to know what your doing and I know what I am doing. This is buisness and in 48hrs I will start the task of either retriving the coin or the money through your local police and court systems. Feel free to contact me at anytime >>

The coin never arrived........... PERIOD.......... I tried to contact the seller, but he wouldn't respond to emails or telephone calls......... He has emailed me once complaining that I have "put him in a bad spot with Paypal".......... I know he's gonna "neg" me, but thats unavoidable at this point.......... Should I be concerned that this psycho is threatening me with police action?

  • The local police won't do anything. You have all the facts and will be fine.

Many departments won't even send an officer out to a car crash unless there are injuries. They won't do anything for a crazy from Canada complaining about an ebay item. If an officer does come out explain everything, and print out any records and give them to him.

Tell him you don't need 48 hours. You didn't receive the coin, and he can start now. image

Politely (but firmly) remind him that you never received the coin. Report him to Ebay now, and let him know that if you receive ANY type of threatening communication from him again, you will report him to the authorities.

Is there smoe outside chance that this seller has a proof of delivery that you are not aware of?

Try again to work with him if he otherwise seems like a reasonable dealer.
  • FWIW.........

Unfortunately you can't stop him from giving you negative feedback. You can neg him back. Just be glad you got your money back and if the coin does show up be the good guy and send him his money back. I have had some stuff I've sent to Canada take litterally forever to get there. Plus the junk has to go through customs. Depending on what he put on the customs slip, it could be held for opening and inspection. (They open a large percentage of things listed as "gifts.")

This is one of the reasons I only buy if I can pay insurance on the item. I don't need wackos threatening me, especially Laura.

Tell the SOB to pound sand and don't be Mr. Nice Guy about it. I'd be non-threatening about it but I would tell him I would be seeking legal action if he kept harassing me. If the coin was important he would have sent it with delivery confirmation at the least, and would have recourse against the postal system for the lost item.

He's from Canada. You can't buy delivery confirmation through another goverments postal service. Registrered will get a signature and that would be the best way to go.

I don't sell or buy nearly as much as a lot of people on this board, but I ship everything with insurance and delivery confirmation. That is not an option - it is required and included in the shipping charges. I also won't buy anything unless it is insured. The only problem I've ever had was with items that were not insured.

Looking at his feedback, it's apparent that he sends coins in such a way that it is easy to tell coins are inside. If he isn't using the proper customs form, a lot of his stuff may be getting intercepted by customs.

The local authorites will not do anything with a guy from Canada telling them a story about a friggin coin. They have bigger fish to fry!

    He is a spook.

Yes...I think delivery confirmation should be a mandatory thing...I add them to all my auction sells...whould stop a lot of this bs for .45-.55 cents....

I think his threat is bogus and he may want to intimidate you into not leaving him a neg.

I will say it again.....Delivery confirmation is worthless when going to another country.

I would send a sharp email back telling him exactly what to insert and where.
  • SmittysSmittys Posts: 9,877 ✭✭✭✭✭
Just tell him you've done nothing wrong and you're not worried.
I would keep a copy of everything handy just in case ebay questions you.

As for delivery confirmation, you can't get it from Canada, second it's only .45 this is ture but
you can only get it on priority mail or higher so it's 3.85 postage minimum plus .45. So if you want delvery
confirmation then add 4.30 Postage to everything and that's with no insurance. And one more point delivery
confirmation only shows a package is lost doesn't do anything for replacement, but hey that's another topic.

Here's what I would write to him:

"Judging from your feedback I think your hollow threat is laughable. However if you wish to pursue the matter with the police, by all means
please do. I would love to see you spend thousands of dollars and countless hours travelling to my jurisdiction in order to pursue this matter
    in court."

That's another reason (among many) why I don't buy from or ship to any country outside the U.S.

I don't think I'm wrong. Many larger cities here in California do not dispatch an officer to non injury accidents.

  • After he leaves you his negative feedback, you sould go to the Taiwan eBay and leave yours. From other threads posted here, they say you have more characters, 125 versus 80, to use when you leave your negative statement.

You may want to open an English version eBay in a pop-up window along with the Taiwan eBay in another window to make sure your hit the right links. The feedback link appears to be in a different location but will look the same once you find it (except the text).

    Hi Stacy,
San Francisco PD will not ordinarily investigate non injury traffic accidents- a real pain as I have been burned twice! in the 11+ years I have lived here. Even when my car was boken into in my GF's driveway, I had to call a district station and nicely they came out- the dispatch officer wouldn't even dispatch someone out! (although there was something wrong with him- he was rude and hung up on me when I asked his name). In my experience, most SFPD officers are very helpful in such situations-IF you can get them summoned.

He can call up your local police department and file a criminal complaint.

But the conversation would go something like this...

"I sold a coin to this guy on eBay and he made Paypal give him a refund because he said he never got it."

The cops would just tell him it's a civil matter and to file a small claims case.
