...and have the seller refuse to honor it because the selling price wasn't high enough (even though they didn't use a reserve)?

nope but I would report it to Ebay. They are in a legal contract to sell it at the ending price to the winner.

Yes, I have a couple of times. Once a $5 liberty worth about $2,000- I was the high bidder on it for something like $100 and there was no way I expected the seller to take this kind of loss another time I won an auction for $50 and the coin was worth a $150 I also let the seller out of the deal because he said he forgot to put a reserve on it and also it was listed in the wrong catagory- I think stamps? I like getting a good deal as much as the next guy but I don't want to see the seller lose like that. mike

I saw some coins with a ridiculously low BIN price. I contacted the seller who quickly fixed his mistake.

I saw and bought a 1/2 oz plat from DHRC for 109 last year I new it was a mistake and emailed them why I bought it they were very Thankful and shiped my next purchase with free shipping

No....but I have had a couple of coins that were won with very low prices get lost in the mail. And funny thing, I never had to sign an insurance claim form stating I never received it prior to getting a refund.

I agree with JBStevens. The auction is a legal agreement between two people. If he didn't put a reserve on it, that's not your problem. Sick the Ebay cops on the seller.

One other thought: If you (the buyer) refused to pay, you'd get in all sorts of trouble: Neg feedback, reported tp Ebay for non-paying, etc. What's the difference when the other side refuses to sell? NONE!

The title said one thing, the picture was another. They said the picture was correct, but my bid wasn't high enough. Asked the rep to reconsider, then I was called a scammer and dishonest (via email).

I emailed someone much higher on their company totem pole and will wait to hear back from them before I do anything.

I recently purchased off BIN from e-bay and the seller contacted me a week later to advise me he sold the coin to another party and listed the coin while not in his posession. Fortunately. he did refund my money promptly but I sure would have preferred the coin.

Care to post a link to the auction? I'm just curious to see it. Personally, I would forward the part of the eBay user agreement that states that the auction is a legal contract, etc. I would firmly (but professionally) tell the seller that you bid in an open auction and the market was such that you were the winner at the price you bid, and if they do not send the coin you will seek legal recourse.

Remember- somethings "value" is simply what someone will pay for it. If you got a coin for $100 that others are selling for $10,000 then it simply means that at that time and place the "value" of the coin was $100. Previous sales, book prices, etc. do NOT establish value. Your winning bid established the value.

Yep - waited for the coin to show up & it never did. When I contacted the seller he
told me he sold it to someone else by mistake. That got him a NEG on Ebay. I've
never bought from him since. Alex

No, but once I saw a jerk close refused to sell an item because the price was about$2-3 bellow the price.

I've had te same previously mentioned experience.You win something ridiculously cheap,pay, and it doesn't show, with the seller all too happy to refund your money without looking into insurance or anything.

Yes, it happened, I reported to the Ebay Fraud and received a message that shocked me. The message basically stated that they attempt to have the seller honor their auction, however I should not expect to have someone sell an item to me at less than cost and Ebay basically could only recommend strongly that the contract be completed by the seller - which in the end wasn't - It seems that the only one contractually required to complete the purchase is the bidder since the seller has many excuses that they can use to not complete the agreement.

On Thanksgiving weekend I bought on ebay a great looking ms63 1912 gold indian $10.00 for $800.00 a good buy today . the seller e-mailed me he pictured the wrong coin and sent me pics of the 1912 I would get. It was no way even close. he let me out of the deal but i think i was scamed
