This supersedes the opinion of the three judge panel that initially heard the appeal. As stated, SCOTUS denied review.
The more likely scenario would be for the government to sell them and then keep the profits.

Why 9 of the 10 coins are not in a vault outside of the US is hard to understand. One, I would have sent to the mint for verification.
What I heard was that the government would bring one or more to big shows and show them to collectors.
Yes, they were gloating about having "recovered" them.
