E-Bay Sales Tax in FL

I noticed E-bay started collecting sales tax here in FL for US coins starting Jul 01
Is that legal?
If I buy from any major auction house or dealer, no tax is charged. I cannot find any answers through e-bay help.

the new FL law started Jul 1.

know your coins and bullion law well. you may need to argue a case in the future.

Talked to customer service rep. They are filing a 'notice' with the tax dept. I asked them if they can give me an e-mail when this is resolved, but I don't think they will do that.
I bought a $300 coin 2 weeks ago and was charged tax for the first time.
Does anyone know if there is a threshold where no tax is collected?
I am not going to purchase a several thousand $$ coin and find out at checkout that they added 7% tax !!
I'd just assume NOT buy from E-bay unless it is an auction or a coin that is rare and priced right, so I can take it into consideration.
I don't have the patience to deal with cust service either.

Had FL sales tax refunded recently by ebay after providing them with this:

Florida tax exemption for coins, currency and bullion

I don’t understand why eBay is having these idiotic problems. Did they build their own tax software? There are commercial solutions available that would make this very easy for them and virtually error free. Surely that has to be more cost effective than what they are doing now.

Or is it possible eBay is illegally collecting the sales tax from the consumer and not paying it out to the state? It's likely most of us won't be persistent enough and put in the time to get a refund. I don't speak Unicorn.

    I love them Barber Halves.....

I don't think there are any commercial solutions that fix the problem. The problem is exemptions. Walmart can code the taxability or the categorization into the item they list. Ebay doesn't control the listing, the sellers do.

Ebay had everything working correctly when the new sales tax requirements were rolled out.
They can do it, they changed it or there is a glitch.
They are making money every day they don't fix the problem.
It will cost them money to fix the problem.
The is no incentive to quit fleecing the flock.

If ebay was losing 6% off every sale they would have fixed the problem long ago.
Because they are making an extra 6% it can wait over 7 months to fix the problem.

You’re right. Categorization is an issue. Not sure how eBay will tackle that.

@jmlanzaf "Ebay doesn't control the listing, the sellers do."
@slowhand "You’re right. Categorization is an issue. Not sure how eBay will tackle that."

It is correct that there will always be a problem if a seller lists a coin in a category other than "Coins & Paper Money."
It is not a frequent event that sellers list coins in "Home & Garden."
The coins I have purchased were listed in coins & paper money.
There are plenty of other buyers having this problem and I doubt all of the other listings were in a wrong category.
Ebay had the system working properly at one point, they can do it again.
After 7 months it is time for ebay to end the incompetence and poor customer service.
Ebay has the money, the employees & the technical ability to correct the problem.
To not correct the ongoing problem once notified is theft by deception and tax fraud.

It's more than a category issue, some items in the coin category are exempt from FL tax and some are not. Simplest fix would be a standing link to ebay sales tax department for individual item resolution when tax was improperly applied. A way to file a claim for tax refund.

Yes, if ebay is for some reason unable to fix the problem they have had plenty of time to streamline the refund process.
There is no reason for a refund not to be issued within 24 to 48 hours after a request has been made.
3 months to get a refund is just not right no matter how you look at it.
Others have mentioned they have had a "hard time" getting a refund so it is not just me having problems.
You shouldn't need to have a hard time getting a refund when ebay has been aware of the problem for over 6 months.

It's just very poor customer service bordering on criminal activity.
