    I hope that, if this is a bad guy, other victims take all the steps you did. If the USPS sees a pattern, maybe they will prosecute. It's funny...keep track and maybe if they eventually bust the guy, maybe PP will make you whole. I wouldn't hold my breath.

    The fact that he won a chargeback does not relieve him of his obligation to pay for your item if it can be shown that he did receive it. Paypal's rules are just that, their rules which are not law. It would seem that a successful chargeback could be filed in every situation that does not require a signature to prove delivery. You always have small claims court if necessary.

    True, but from my understanding of small claims court procedures, I would probably have to file in the county where the buyer lives. I am looking at my own county's guide now and it says:

    A. Where to file.

    1. If your case involves a consumer transaction, you may file in the county:

    a. Where the customer lives, or b. Where the purchase was made, or c. Where the collateral is located.

    Given the purchase was on eBay, I'm not exactly sure how "b" would be determined... "where the purchase was made."

    The buyer lives 800 miles away from where I live. If I'm required to file in his county's small claims court, I don't see this action as too viable an option, given the time and expense I would have to invest.

    The card company seemed to decide that pretty fast. Did they have your proof of delivery?

    I would ask Paypal to reopen it and provide the proof of delivery. Yes you didn't follow paypal rules, but those rules are not the same for the card companies.

    As for pursuing this in small claims court....waste of time.

    Also the postal inspectors could care less. Anyone who says differently has never dealt with them. I have a case currently in front of the postal inspectors that is pure out right fraud. (three different credit cards from three distinctly different people all going to the same address with 3 different names that don't match the card holder names), and the postal inspectors could care less.

    Best just to move on and be glad it wasn't more $$$

    Did I read in the original post that you self insured this item? If you used postal insurance then there has to be a signature if the insurance was over $200.

    IIRC he did not purchase a great enough amount of insurance to require a signature.

    Agreed small claims is a waste of time, but if one wants to do it based on the "principle" it's still an option.
