I have the number and a link from Jim. I will do something about it. Just not today.
This mess took up my whole day and I am just glad it is somewhat over
<< <i>BTW, how was Gatlinburg this past weekend? The weather wasn't too bad down the mountain a few miles. >>
Overall it was great! I didn't make it to the card store as much as I would have liked to due to icey roads leading down from our cabin. We went to a spot we always visit the next day. It is almost to the top( Clingman's Dome). The snow was falling and it was 17 degrees. We had to cut the snow playing short due to weather but the trip was nice.
Here's a funny short story about Gatlinburg: My wife is from Chicago, and I'm a lifetime east TN native. The first time I took her to Clingman's Dome the temperature in Knoxville was around 50F. I casually told her to grab a jacket, it would be cold up there. She said something like "I'm from Chicago, I'm used to cold weather." I said OK, and off we went. At the top, I doubt the temp was above 30F. She was shivering so hard I could hear her teeth rattling! I took my coat off and gave it to her, and asked her if she would listen to me about the weather in Tennessee in the future. She agreed to that!
Another quick one: We took my wife's sister and her fiance to the top overlook one time they came in from Chicago in Feb. It was foggy and drizzling in Pigeon Forge, and snowing at the top. My future brother in law stood at the top, amazed that he was above the clouds and the temp had dropped 20F in about 15 miles of driving!
May he feel an unbearable burning sensation every time he takes a pee.

Got a quick question Matt... If this guy has benn getting away with this more then a couple of times? how does the deliv confirmation not show up?
He might no someone that delivers the mail. that doesnt scan it. i hope they dig into this alot deeper. bc if that was to be a problem that guy should be fired..

Here is my theory. He is obviously an experienced ebay buyer / seller given his multiple id's. He knows how to scam the "system". I am sure he checks every package he gets. If it doesn't have dc, that is easy for him.
If it does dc, he will check to see if it has been scanned. When he gets some that are missed he will initiate the claim.
Or, it could be what you and Jim think. You never know.
I guess i will modify my shipping statement to include that "if you bid on my auctions which all include delivery confirmation (within the U.S.),you acknowledge and agree that all responsibilty lays at the door of the following carriers-- USPS/FED EX/UPS/DHL for any undelivered packages. No refunds will be given by Paypal or by us for any lost items with tracking numbers. By placing a bid on our auction you agree to our terms. No Exceptions".

Carew29 unfortunately if you accept Paypal your personal auction terms are unenforceable. Paypal policies supersede anything you put into the auction but feel free to give it a shot.
I really don't understand how it is the buyer's problem if the package you ship isn't delivered. If the situation were reversed (you were the buyer and some seller had a DC # that didn't show delivery occurred) you would be up in arms if Paypal or seller didn't provide a refund. The transaction is not complete until the goods are delivered. Granted it looks like this was an attempted case of fraud but items are lost in transit. It is the responsibility of the seller to make sure items arrive. In the end all it means is that you need to insure all items you send, end of story.

Yup.
Under the PP scheme, seller is responsible for safe delivery.
USPS insurance is cheap.

Even though it worked out for you , I think he deserves a kick in the twig & berries for all the time and trouble . . .and just for trying to get over,
I wonder how many people got scammed by this guy . .
What a punk dirtbag. It's almost like responsible sellers are at the mercy of the post office in cases like these, where even if the package is delivered, if it's not also scanned, it's a free ride. Disgusting. Glad it worked out in the end, Matt. I hope you file a complaint on this POS. Guys like this deserve to pay for their crimes, or he'll just keep on doing it to the next unfortunate soul.

On a side note, I believe that insurance is for the seller. Just insure everything that's sold and if a problem arises with stuff getting lost, then the seller could file with the USPS and get a refund to give back to the buyer. Less hassle, less hoops to jump through. It may be the buyer could still be scamming, but at least the seller has insurance for back up and then its up to the Post Office to make sure it is not a scam. Of course the seller can help with that investigation, but at least there will be some piece of mind.

Absolutely agree. And is ebay out of their friggin' minds eliminating negative feedback for buyers. Legitimate, good buyers aren't worried about a retalitory neg now and then from a seller...I mean what seller is going to worry about a good buyer who gets a neg once in awhile? But the scammer buyers like this guy, will now feel free to run rampant on ebay trying to scam sellers and the only way to get back at him in feedback is give the POS a positive, with negative commentary.
Great ebay feedback sysytem now right?...forced to give him a nice green positive in order to get in commentary such as, "Don't sell to this POS scammer" - I guess now sellers are going to have to waste time wading through all the commentary about the buyer to get an indication of him, rather than just quickly looking at the negs and reading that commentary.
<< <i>I guess i will modify my shipping statement to include that "if you bid on my auctions which all include delivery confirmation (within the U.S.),you acknowledge and agree that all responsibilty lays at the door of the following carriers-- USPS/FED EX/UPS/DHL for any undelivered packages. I'll have to tweek this a little more. >>
Yeah, good luck with that. Exactly how is the onus on the buyer if something you ship doesn't show up? Why should that person be out $$$ because the shipping carrier YOU chose lost a package? How does that make sense?
It makes absolutely no sense that the buyer is responsible for shipping mistakes. The seller is the one that has the authority to insure a package, not the buyer. I know many sellers try and coax the buyer into paying for insurance, but if that does not work, then the seller best pay to have the item insured.

It was not the OP. It was me. The facts in my situation seem very similar to what happened to the OP. Although the item could have been lost in the mail, or delayed, this thread from a couple of years ago makes me pause. The transaction was made through ebay Ebay listing link. He used his abejam11 id. I had not known of this thread when he won the auction, through the dispute phase, or when he received his refund. Until tonight. Of course as I said above, the card could have been lost or delayed and he still may receive it later in the mail when it is found at the bottom of the mailbag or in the post office. But this original thread makes me wonder. I checked his feedback and it has been good recently. Many cards won on ebay with no complaints, and bought from members on these boards. So things could be kosher. But you never know. So I have sent paypal the link to this thread and asked them to review and reopen the buyer's dispute and look into his history. We shall see what happens.
Response received from paypal already. Less than 12 hours later. Not good for me. They found for the buyer as there is not enough support to find there being a problem with the buyer.
I did not use DC. I was rolling the dice and it came up snake eyes.
<< <i>I also wonder if this guy is paying off the carrier not to scan the item when it arrives so he can make claims? >>
Twiley you don't really believe that.
Do you?
Steve >>
No I don't believe it is happening with these examples. However if many people report having DC issues showing up as delivered via the carrier to this thief. Then it could be a possibility couldn't it? If the thief is stealing high dollar cards and reselling them. I would think he would have a lot of disposable income.
Never saw the original thread, but after reading most of it, it is amazing that this clown is still even allowed to be on ebay, much less pull the same scam. I did look at his feedback left for others, he not only negged everyone as a buyer but also as a seller (back when you could). He was one of the tards who used feedback retaliation who started the whole FB nonsense.
I also noticed in one of the posts going back 2 1/2 years ago, that it was thought that fixed price auctions would be rising in number because of a variety of reasons, including cost of shipping and the needing to cover ones own butt on Paypal claims. Turned out to be prohpetic and ironic as well because those Mr and Mrs Cheaps out there that would see shipping charges then leave negs for it are now the ones complaining about there being a smaller number of auctions to bid on and get that "cheap" stuff AND they still complain about shipping

It's a great scam isn't it? If this loser happens to be in a situation where he KNOWS the item didn't get scanned or there is no DC, he just claims he never got it and it's a freebie. For the ones that he knows did get scanned, well he paid for them and they are in his collection the legit way and he gets positive feedback. And since the seller can no longer leave him negative feedback, he has no risk. If only one out of every ten packages comes in for him without being scanned, it is still worth his while. I live out in the country, and I doubt my mail carrier is scanning everything. And when something comes UPS it just is sitting on my porch when I get home. In the past three years I've probably bought $10k worth of cards, and I have maybe signed for 3 packages. Someone needs to figure out a way to turn the tables on this guy.
