46 months in prison!

John E Paaul (51) of Wisconsin was sentenced to 46 months in prison for not sending coins to winning bidders from ebay. its in cw jan. 7th issue. page 10. $ 171000 worth of winning bids. no coins. what are some thoughts on this?

    So, his annual salary for the crime is equivalent to over forty grand per year TAKE HOME pay, 3 hots and a cot all courtesy of taxpayers. Who said crime doesn't pay ? Not only that, he gets anonymity. No junk mail, no messy tax forms, and cable television. America is such a great country. I hope he practices abstinence. image

    Probably an accurate sentence for a first time offender. The next time, he will be there for much longer.

  • i seem to recall that someone told me (corr. officer) they get cable tv. I think its a fair sentence. somewhat. he should have lost a hand.

    For all we know, he may be out in 18 months.

    Another guy here locally just got a ton of probation and restitution judgement for doing the same thing with laptops. I think it was about $20k total. Making restitution payments is part of the probation conditions.

    As well as part of the terms for an otherwise lighter sentence.

    I know someone who was widowed, and he took up with a woman who was a con artist. She married him and proceeded to get him unwittingly involved in some embezzlement of an account she had power of attorney for. She wound up with a lot of jail time but he got a couple months' house arrest followed by probation and restitution, because it was obvious to the prosecution that she was the driving force behind it all and he was a dupe. She had some priors and some aliases that he didn't know about and got snagged into her web, whereas he spent many years as the treasurer of his union before he retired and there was never a question about where one dollar went while he wrote the checks.

    It will be interesting to see if he can come up with the $165k in restitution.

    Seems like a fair sentence if he can make his victims whole - almost 4 yrs in the clink. As I recall, the federal sentences tend to be served in full - no 'early outs'. I am sure others have a better perspective on this - I don't know any criminals.
