No, I'm in Los Angeles, but I figured that I could guaranty you full recovery of your initial $730, cut your anticipated attorney fees in half and let you keep the coins -- all in 30 days!image

Seriously though, as an attorney my advice is don't waste your time, or the court's resources over such a trivial matter. There are other people far more wronged than you that need to utilize our fine "justice" system. Cases such as this only clog up the system and cause delays. To be honest, if your attorney did handle this on your behalf and charged you $25,000 in fees and he actually filed a complaint in Missouri, he should be disbarred.

Just to let you know, if your attorney hasn't told you, you have a duty to mitigate your damages. So you really should sell the coins at the best price possible and then the difference between that price and your purchase price would be your actual damages. In actuality you're probably talking about $400 at most that is at issue. And by the way, your other recourse is to have PCGS review them under a grade guaranty and recoup your investment.

Go race a Viper, pet your fish, create a webblog or buy another bride, but please don't involve the courts or an attorney in this matter.

The principal in this matter is the retaliatory feedback for no reason, the coins are secondary at this point.

What that person claimed is untrue, in my book that's libel.

Like I said, I'll take this all the way if needed.

At the risk of keeping it civil and addressing the issue here...

What are a set of 18 PCGS 69s worth in the marketplace? If these coins are true POS's (I can't see any of the pictures that have been attached before), maybe PCGS needs to review 'em and possibly make it right on the grade. I don't know that they'd refund $700+ even if they agreed that some of these were no-way-in-hell-MS69s, but it might be better than nothing.

As much as the seller is one I wouldn't deal with because of the no refunds (actually, it says "on refunds," not "no refunds") and stuff. But even so, presumably that was clear when making the purchase, so let's not leave PCGS out of the fray here. They slabbed this (apparent) junk as MS-69.

My lawyer thinks this guy has a habit of misrepresenting coins.

He does love the on refund terms.

Come ON give me my refund!

Also, he left retaliatory feedback, and has intimidated others if they leave a neg, they get a neg in return.

Go look at the positives on page one you can clearly see where a member not once but twice left a positive feedback claiming what I'm claiming.

The ANA is also going to review this case.

By ANA rules, no matter what the issue is, an ANA member HAS TO refund the money on ANY numismatic item, if the client is unhappy.

You know, I believe in standing up for principles and all that, but let's be realistic here. Over a matter of $730, you will be ending up in small claims court. One does NOT get a multi-million dollar judgement in small claims court. You will NOT be taking away his home, business or his wife and children over this. Your legal fees will easily be much more than what you could ever possibly hope to win. Best bet here if he refuses to take the coins back and refund your money is to go through the buyer protections built in to ebay and Paypal, if that's how you paid. You'll pay a fee, but you'll still get most of your money back.

Instead of donating $730 why don't you forgo the lawsuit, and donate your attorneys' fees to a charity. The $25,000 will be much better spent. And I tell you what since I am on the SoCal Board for MDA (Jerry's Kids). Donate the $25,000 to the MDA and I'll pay your way to our next fundraiser -- Dice on the Beach -- October 1, 2004. I'll pay for you and your wife to fly to Los Angeles from Las Vegas and will even put you up for the night at the New Otani Hotel in LA and will even have you featured as a "Special Guest of Honor" at the event.

If you get past his pittbull of a wife and talk to Jay, I'll donate $250 for starters.
  • Options
C'mon MrPlatinum money's no object, right. $250 that's it -- for starters -- that wouldn't buy a wheel for 1 wheel chair for 1 kid.

If you use 200 ounce palladium bars as doorstops certainly you can do better than that????

If you're ready to pay some attorney $25,000 to chase $730 certainly dropping $25,000 on Jerry's Kids shouldn't be a problem. I've already offered to fly you and your wife to Los Angeles, pay for your hotel and make you the guest of honor at the event. Have you ever been the guest of honor at a charity event???? H*ll, I'll even through in a limo for ya.

Step up to the plate. BE A MAN. Put all that money you claim to have to use for something positive for once. Help a child that will never walk have some enjoyment in life before he/she dies.

Do you have what it takes to walk the walk????????? Or are you all bravado with nothing to back it up??????????

I'll step up to the plate once JP answers you.

FYI my legal bill is not $25k, if it is it'll be on his tab, if there's a judgment.

I believe it's called reasonable attorney fees.

Quite often I send in silver eagles to PCGS and when they come back they start to form those white spots or haze. Over time it gets worse and worse. I'm sure when PCGS originally saw those coins they didn't have those spots. That's how those coins get those grades.
  • Options

<< <i>FYI my legal bill is not $25k, if it is it'll be on his tab, if there's a judgment. >>

I have a better chance of getting you to donate $25,000 to the MDA than you will ever have of collecting legal fees from the defendant.

It doesn't happen in today's system.

But that still begs the question -- if you have anywhere near the money you claim to have, a donation of this size should be pocket change for you. I use little wooden doorstoppers and I can donate that much.

You said money isn't an issue for you. You claim that you could buy and sell most if not all of us on this Board, well prove it. Do something useful with your vast wealth. Help a child. You obviously have a son that you're proud of, some parents will never get to see their child graduate from grade school because of MD no less get offers to Ivy League schools for college. Make that family's life a bit easier. Haven't you been blessed???? From your posts I read you like to think you're God, now here's a chance to play him for real. You get to help change a child's life forever. How's that for being a God?????

    C'mon Leo, BE A MAN.

    Frattlaw -

I applaud you and your dedication to such a worthy endevour. I cannot tell you how many doors I knocked on as a kid collecting money for the MDA telethon (back when kids did that I guess. When I was 12 I had my best year ever (in 1973) by turning in over 230.00 of collected pennies and dimes. I did not even cherry pick 'em either.

    Mr Platinum -

If you push as much money around as it appears, just denying this dealer your business should be more than ample punishment for the way you feel treated. If your word is as good as you say then telling other people you deal with about the shoddy treatment you apparently received would compound the punishment. It seems like you are punishing yourself by wasting time and energy on this. You could be making more money doing something else. I understand about the princilple of the matter, but in todays seemingly inscrutable legal environment, you cannot guarantee anything if you pursue this so hotly.

<< <i>I applaud you and your dedication to such a worthy endevour. >>

Thanks, I appreciate that. I just felt that I've been quite lucky in life and it was about time I started to give a little in return. A friend of mine is the SoCal Events Director for MDA and asked if I could help out. I had already gone to a couple of their events and got to meet a couple of the kids and thought to myself what a great charity. BTW -- 78% of all contributions go directly to the kids. So this is a really well run organization.

Why not help? If I can help make a difference in one child's life or help bring the MDA and their research scientists one step closer to a cure, what could be more rewarding in life???

I use to think it's how much money you make, then I thought it's how much money you keep (from the govt) now I am at a place where what's important is what you do with that money is what counts.

Life is too short to worry about your Vipers, tropical fish, beating someone in a Registry contest or what your doorstop is made of.

I'd rather see the smile on a child's face when they realize you are sponsoring them to go the MDA summer camp for a week of fun and games and a little independence from Mom and Dad.

    Michael

PS -- Hey Leo -- where did you slink off to?????????? No response, that's what I thought.
