    When the set came in, I E-Mailed the seller asking for a refund and he basicly told me to pound sand! Had to do it!
    It is not exactly cheating, I prefer to consider it creative problem solving!!!

    E-bay says he did nothing wrong. He shipped a proof set. They got their fees, end of story...

    So you gave him neg. feedback and complained like hell for the shipping that was listed in the auction. Oh, and buy the way he did not say the picture would be of the item listed either. And why bid over $10.00 for a set that books for about eight dollars.

    I E-Mailed the seller and was told the set in the picture was the set I would get. As for the shipping, I missed it. Yea I asked about it and figured it was my fault. When the set came in and it was not the set in the picture and the seller refused to give a refund, you rack it up to experence and have an auction.
    It is not exactly cheating, I prefer to consider it creative problem solving!!!

    If a photo isn't the actual one to be shipped, the one to be shipped should be equvalent to the photo. It shouldn't be crap.
  • That sucks. Unfortunately, this goes on all too often. I'd like to think that in some cases the sellers are just plain lazy by using the same picture over and over but it always seems that a very choice example of the item being sold is pictured. Quite awhile back I purchased a 1950 proof set expecting similar quality. Coins didn't match the pictures (they weren't even in the same holder as pictured) and the seller accused me of pulling a switch when I returned them. It took me 6 months of bugging the crap out of the guy to finally get a partial refund. I always check the past selling history of a seller to see if the same item has been auctioned over and over (like proof sets) with the same picture. It has saved me money in the past few months as this is more prevalent now it seems.

    Yep and I filed a complaint. Paypal says if the set was delivered and it was not broken, there is nothing they could do.

    It's only because he said that was the set I would get. It wasn't end of story! The seller is a sleeze, charging $8.50 and then spending $1.61 to ship the package, that complaint is still being looked into at E-Bay, excessive shipping is against E-Bays rules.

    Not only did Marty get screwed on the set, he got a BS retaliatory negative. I also see this seller charged $8.50 to ship the set.

    Yes it is unfortunately, eBay doesn't do well on the enforcement end of their policies. I got hit for $35.00 shipping on 2 auctions for a total of $70 which the guy shipped combined for $11.81 I also paid for insurance which he wouldn't honor <He claimed he self-insured it> and the guy got away with it. He shot down my paypal and my eBay complaints. If you go back in my feedback you'll see it's the only negatives I've ever gotten hit with. You also see that the guy finally got his due. If the guy is in fact a scammer he will eventually get his due as well. I do like the set you received and sincerely hope to win it. As is consistant with my bidding, I bid a fair amount and most likely will get sniped, if I do, congratulations!

    Paypal says if the set was delivered and it was not broken, there is nothing they could do. It's my opinion that eventually this kind of thing is going to bring down Paypal and ebay. Someone, somewhere will eventually have enough of it and we'll see the biggest class action suit ever filed. JMO.

    It looks like this person bought the same 1969 proof set in auction 3912025552 and left the seller neutral feedback stating "Reply by protocol44: Don't sell damaged goods if you don't like complaints"

    And Marty's photo looks exactly like the original sellers photo. So protocol44 knows he had a POS proof set to begin with. image

    Of course he did, and used eBay to unload the POS set. Kind of like what another seller is doing with raw seated coins.

  • I get this all of the time..... I cherrypicked a nice VAM the other day..... they send me a different coin.... I send it back.. ask for the "piuctured coin" and they wouldn't send it.... (guess they found out what it was) this is my pet peeve.... They actually sent me a total refund and a $ 9 Peace $ to say he was soooooo very sorry and that they'd LIKE to KEEP their $ 100 coin I tried to buy for $ 12.... Still going to neg him...... image

    But I wonder if the scammer knows you have posted this auction. It wouldn't really show up on any searches I normall do!

    I would use that "email this item to a friend" feature to put him on notice.

    Maybe if 100 or so of the board members also did this, he would get the message that he is being watched.

    I don't think the seller really cares. He knows there are people who look for Cameo proofs and he sticks that nice picture in. Then hits you with the $8.50 (more then the set was worth) shipping. I'm sure he gets a newbe a week. I have filed a complaint with E-bay and one for fee avoidence (High Shipping).

    "I understand that the coins shown were not the ones shipped. $8.50 to ship a set of coins is ridiculous. You're going to lose a lot of business because of shoddy transactions like this."

    In auction 3912025552, jezjesk was the original seller and provided an accurate photo. Protocol44 won it and then turned around and resold it to Marty, but protocol44 used a different photo to sell it.

    Ain't that the truth! Stock images are common, but I think it's more than coincidence that the sets pictured frequently have great looking cameo coins in them. Experienced eBayers know to eMail and verify the image but, as we've seen here, even that doesn't always work since some sellers are liars.
