Grade review questions regarding 25th ASE set coins

I purchased about forty of "70" graded Mercanti and tombstone labeled 25th ASE set coins on eBay and from dealers. As many have noted some of the coins seem to be very generously graded- maybe 25% graded as 70s that look more like 69s-so I now ask the sellers to hand pick nice ones (which has worked well) and look for auctions/dealers with return/exchange privileges. To the point I have a couple of the bullion coins that quite honestly have so many pinpoint shiny spots and small scuffs that I think would easily knock them down to at least 68 levels. Reading the rules for grade review if the coins get 67 they would be considered clerical errors and not covered( so I am out the entire cost of two way postage and grading fee) Has this ever happened to any of you? The rules also say replacement cost is what a dealer would pay- any idea what first strike ms70 nm 2011 ASE set coins go for? Is it worth the cost /aggravation/risk?My other option would be to list on eBay and describe as generously graded....

I've been going through a lot of these coins and it's constantly the same issues. There's shiny dots, there's black marks, oh oh and my favorite, I have a 70 that has a CHIP on the sun!!!!!! WHAT!?!
I am going to post a bunch of pictures when I get off work. Sorry work has been busy been saying I would be posting pictures but haven't had the chance. Company is going crazy right now with busy work, the forums here are my relaxation period lol.

The Mercanti labels are going for around $125 - $130...The flag labels, around $170+
