Out of the Loop

It's been quite a while since I posted anything... and even longer since I added to my collection, excepting a 2010 SAE to keep the numbers consecutive. But that's not really the focus of my collecting these days... I was really hoping to focus on building a nice Type set, but...

...this dang lawsuit I've been wrapped up in for 3 years is coming to a head now, and the fees, the time, the depositions, and soon, the arbitration, have all but drained me. I think it will all be worth it in the end, as I believe I'm in the right, but law is a funny thing, sometimes... it can bite you in the backside.

I was lured into a deal with someone I thought was a friend, someone whom I trusted, and as it turns out, the temptation of the almight buck got to him a little deeper than the value of our friendship. Turns out, he was pushing the real estate envelope game, and his house of cards fell in on him, and dragged me along the current. It didn't help that his penchant for gambling set the stage for how he approaches life in general, but that's another story...

So, soon the arbitration I've been awaiting will come to pass, and when it does, I believe he will be surprised. He will not expect that I have witnesses with iron-clad pedigrees. He will not expect his lies in deposition, under oath, to be countered or perhaps, even challenged, but this miscreant could have been better prepared. And, he could have chosen NOT to dismiss his attorney, only to defend himself (fool for a client?).

I'm not a gambling man. I don't even have an Ace up my sleeve. I only have the cards he dealt me, and have no need to draw. Funny, that, since the art of the deal was his pride and joy... he has a couple of pairs.... but it'll never beat a straight flush.

Then, perhaps, I can focus on my hobby once more, and pay more attention to all the fine tips and advice I've come to appreciate while a member of this forum.

    I too was right one time. Also took over 3 years and 3 hearings (I won them all). Got treble damages
    but no attorney fees (wasn't mandatory in that state for this lawsuit). Lawyers settled for what I got.
    I came out right and 3 years of fees broke. NO fun and was very glad when it was over. I hope you
    come out A-OK.

    I was a plaintiff in lawsuit once, small claims, had to sue a roommate for unpaid rent. I won my claim (about $700), but was unable to collect anything.

    Winning the suit and then collecting damages are two entirely different issues - unfortunately. Cheers, RickO

    I fully expect my adversary will fill BK, should I prevail here, BUT...

    A Judgement which finds Fraud is one of those things, I'm informed, that one cannot escape merely by filing BK... there's a process, but this is one of those things which can be excluded from BK, thus, I intend to shadow this guy - again, should I prevail - until one of us gets buried. Then we go after his estate. Probably helpful that Daddy's got a bundle, since my adversary would not have survived this long without some form of charity...
