Lawrence R. Stack v. Michael O'Higgins

I just stumbled across this while reading about the treatment of intangible assets during an LLC dissolution...

Unfortunately, I have no time to summarize this right now. Maybe some forum members know the background here.

Hmmm.

From a non-law professional reading, it appears that Mr. Stack wants Mr. O'Higgins to stop using his name in the company that Mr. Stack left. I wonder how this has worked for QDB?

Stack & O'Higgins formed an LLC which used the trade name, 'Stack's.'
Stack withdrew from such entity, and pursuant to their agreement, such entity was enjoined from using the trade name, 'Stack's.'
Such entity continued to used the trade name.
Stack sued and got a judgement in his favor that the other party cease and desist in using the trade name.

I wonder if Mr. O'Higgins is related to the Chilean Liberator, Bernardo O'Higgins?

The company is now called Steib's Sales East Coast.
