Really an interesting situation. I bill $250 an hour and just spent 15 minutes reading this... and all over a $20 deal!? Darn it! I do not think the buyer was a DB here. If I were the seller I might show a little more patience next time. Sadly some people take time to pay... for whatever reason or no reason. Plus, once the guy pays just take the money and move on. I don't understand the refunding of the money.

I'm lost... the guy forgot to pay, you sent a reminder and NPB, he apoligized and paid for the auction win. Isn't that how the system works? Why would you not send the card? Neg deserved!

7-days is, as we all know, all the time you need to wait to file the NPB.
The NPB then has 7-days to reply/pay.
How long a seller waits to take action is solely his own decision.

As usual Storm is correct. It is 7 + 7 per ebay.
I imagine re-selling it before 10 days is a little, maybe a lot rash. There was also a holiday this last week. If I was a judge I would blame at somewhere in the 50-50 mark, perhaps penalize the op for starting this thread.
Edit to add: Due to the mislist in the auction, assuming it is an error (PSA 10), I would now find the OP 100% to blame. In any court the buyer would win and could likely get damages from the seller if he had any.

What gets me is that the seller NEVER sent a payment reminder and never considered that the buyer may have overlooked payment. Had the buyer had questionable feedback, I could understand. I just do not understand how a seller could possibly go Postal (no offense intended to our Postal workers on the boards) without having sent at least one payment reminder. It should be automatic BEFORE filing a NPB.
In any respect, while the seller has the right to handle the transaction however they wish, I certainly think this was a mountain made out of a molehill and all over a $16.00 transaction.
I may be in the minority, but I will be certain to avoid dealing with this seller (onebamafan). The loss certainly won't be mine.

hmm. i'm confused here. the third sentence seems to imply that you don't send the reminder until the seven days are up. so, do you send the reminder on the "3rd day" or on the "7th day" or on the "10th day" related to the end of auction?
As noted previously, 3rd day payment reminder (almost all pay before day 7)(unlike buyer in OP), day 8 npb filed and will always be filed then unless buyer communicates with me.
Sellers should never have to send payment reminders, because:
1) Buyers get the end of the auction winning bidder notice.
2) Ebay now sends automated invoices to all buyers too.
3) I'm sure most every seller sends an invoice after the end of their auctions in order to get paid.
To me, three notifications to the buyer that they won an item are all that should ever be necessary.
What should the buyer do, send a reminder too and then if they don't pay in a couple of more days, get their contact info and call them asking them to honor their bid? That's BS.
You file a NPBA after a reasonable period of time 10-14 days. That will always get the attention of the deadbeat or forgetful buyers. Mistakes do happen, and I'm sure some buyers may forget about sending payments. I just don't feel the seller should have to hound the buyer for payment.
It's all about communication, but it's not a one way street. The buyer has a stake in the transaction too. At least they do as soon as they bid on an item.
The buyer in this case has admitted they were wrong in delaying sending the payment. If they forgot to pay, then the NPB filed by the seller was the correct way to go. It got action.
At least the buyer is trying to have the neg. removed.
For what it's worth, I would gladly deal with both of them in the future too.

Wow, a lot of stress over a supposed hobby. I allow up to 2 weeks per my descriptions and with ample communication will give a buyer longer than that. 3, 5, 7 10, 14, 30 days, it's all the same money to me. I had a buyer in Israel run up a six month tab on toys to save on the shipping charges. Plus he was in the middle of a war zone at one point but did pay in the end. I'm crazy like that in trusting people, it's some twisted risk reward thing I have going on in my head. I'd just take the 20 bucks and send the card, that's enough to pay for a bottle of Jack Daniels for me, even if I have to wait ten days for it.
Steve, again its not the $16 , its never been the money. If being a Dick is selling a card to someone else 10 days after your auction ends with no payment or communication from the buyer, then i must be a Dick. However, Dick will continue to file NPB after 7 days w/o payment or acknowledgement from buyer. It is Dick's right to do whatever he feels is in his best interest after 7 days of NON-payment, 10 in this case. Thanks for your witty and well thought out reply CD. Considering many of the board members here appear to agree with me, there must be a lot of Dicks here. Of course you probably are already aware of where all the Dicks are, right cdsNUTS?

This issue is resolved as far as the both of us are concerned this issue is over.......however, NUTS would probably like to keep talking about dicks for some reason? I have no clue? It's good to see that all is now well, NPB and negative feedback rescinded, Paypal refunded, card no longer for sale to the original buyer but hopefully available to rest of us at some point in the near future. My stash of fifty 1990 Topps Roger Salkeld rookie cards can sleep well at night now knowing that order has been restored to the hobby universe.
I'm thinking that maybe in the future you should relax some of your TOS.

Yeah, I'm sure the OP's expectation of the reaction he'd get from sharing his Ebay horror with us backfired a bit. I doubt potential bidders blocking him as a seller was what he had in mind. The TOS in the listing simply said please pay within 5 days. His actions and punishment after the auction were not detailed in his TOS. If this is how he reacts when somebody misses paying for an auction then he really needs to update his TOS in the auction description. First he'll need to remove the word please and replace it with something more firm, like YOU WILL in caps. Then explain exactly when the reminders, NPB, relist, refund, and douche posts will occur if you don't follow his instruactions.
