E-bay seller Shoeless Joe ........Refund Received !!

I'm having some trouble with Shoeless Joe on E-bay, It has been a few days now and I can not get him to respond to my E-mails. I know Neil(thedutymon) has also had some problems with this same seller.
My problem is, I won two auctions from Shoeless totaling over $120+ One card for $40 and one for $80 plus $6 shipping for both cards, A few days ago I received the $40 card in the mail, with .17 cents postage due !
I have yet to receive the $80 card and can't get him to respond to any E-mails regarding the whereabouts of the card. What should I do next ??
Should I file an item not received ?
I am pissed I had to give my mailman another .17 cents after being stuck in the but over shipping anyways. But I am even more pissed this POS wont tell me what is going on with the other card !

    I'd file an INR immediately. That guy has been mentioned here and other boards many, many times. Total scumbag

    Barry was the 80.00 card cheap? I mean was it a 120.00 card that sold for 80.00?

    This guy is a real snake.

    The sad thing is he is covered since you probably paid via paypal and both transactions were combined.

    Yes Steve, it was a card he had a Bin on for $149 that he accepted an $80 offer for. Should I keep the envelope it came in since the Post office could probably still scan it and tell that he only had enough postage for less than one card ??

    Shoelessjoe = slime. I don't know how the guy sleeps at night. If you believe in Karma he's got some misery ahead of him. Stay away, far away. Good luck.

    Here is the bubble mailer I dug out of the garbage, shows 1oz first class mail with .17 cents postage due. Shouldnt there be soeway to nail this guy with there being no way there were two cards in that envelope for that amount of postage ??

  • I'm thinking since there is DC on it, he'll say that he shipped both cards
    in the envelope and you're screwed on the $80 card not rec'd.
    He has so much crap, that I don't even think it'll phase him one bit
    if he got a neg. I don't know how this is going to play out if you file
    "Item not received" claim with PP. Good luck. He sucks....did I mention he sucks?

    If you paid by credit card through PayPal, your credit card company should side with you on the claim. You have to go through the PayPal dispute process before you dispute it to your credit card company though.

    I dunno what to tell you, it is almost like he shorted the postage on purpose so that would work in his favor somehow.


    Wait for Storm, he will have good advice.

    Also I'd do what Goose suggested and call this guy up.

    My wife the usps clerk says he paid $1.17 plus .18 for delivery confirmation, and that it would weigh between 1.1 and 2.0 ounces to get the .17 postage due. He could easily say the 2 cards in toploaders were in the bubble mailer and the weight would be ok at 2.0 or less.


    You have to believe others have had the same problem with the dirtbag, if paypal looks at the seller's complaint history they might tend to side with the buyer.

    I would file either INR or SNAD, depending on what Storm suggests.

    Im certainly not condoning violence with this clown, but honestly, with this guys history, I am truly surprised someone hasnt kicked the crap out of him at a show. This dude is a piece of crap, I am hoping to move to Davidson NC (5 minutes from Mooresville) once my house sells, I might have to look into Mr. Burge when I get up there.
  • Steve, the problem is $80, $60 or whatever amount it is....it all starts to add up
    for this guy. He tried to scam a friend of mine for a little over $200. We told Burge
    to refund him, or there was going to be some major sabotage on his auctions.
    $200 was a drop in the bucket for him, and he thought it over and did refund my friend.

    I don't think it's so much the money involved, but the practices that he chooses.
    Ships when he wants to; doesn't ship; puts you on ignore; crappy services; used to
    charge for insurance on top of s/h but you never see it on package, and so on.

    If they weighed 3 oz for 2 cards, and the package weighed 2.0 or less it should be pretty easy to prove your case with paypal. Since USPS weighed the package, and they obviously did to require the .17, usps already said it weighed less than 2.0. There couldn't have possibly been 2 slabbed cards in there.

    Wait to see which way Storm says to go, then file. Then don't forget the feedback!

    I have to agree that Kevin is a snakey, little, wormy feller. Met him at a local card store a time or two. Nothing special.

    I only live 10 miles from Mooresville...if I need to take care of something....just let me know. As seen on the 1975 Cello Pack giveaway thread, I am currently unemployed and have some extra time on my hands image

    The postage/weight issue is a slamdunk on appeal to a live-person
    with an OUNCE of sense, but the initial INR is a loser IF he uses the
    DC# and LIES about the contents of the package.

    First, wait a little while.

    Try to force the guy to respond:

    1. You can file an INR thru EBAY - NOT PP - and see if he responds.

    2. You can CALL him on the phone, BUT NOT if you are going to threaten
    to cancel his ticket.

    What you want to know - BEFORE you file your PP claim - is what he is
    going to say. That may not be possible, if he does not respond to your
    attempts to contact him; but, it is worth being a bit patient.

    .......

    There is a SLIM chance that he simply forgot to put the second card
    in the pouch. When you have dozens of folks to send GARBAGE to
    each day, you sometimes make mistakes. The fact that he has a
    TERRIBLE REP does not mean that this case is a FRAUD attempt.
    (Probably is, might not be.)

    .......

    If it comes to it.........

    AFTER the INR is decided in his favor, you will file an appeal. It
    should prevail, but may take a supervisor getting in the mix to
    see what's up.

    ......

    Meantime, call your bank and ask if there is any fraud protection
    on the payment method you used. IF you used a debit-card with
    an MC/VISA logo, read your UA and see what they say; most have
    FP. If the payment was STRAIGHT from a linked CA - without the
    debit card - your bank may have some FP, but probably not. No
    way to know, unless you ask.

    ...

    Recap:

    Slow down and try to make the guy lock himself into his "story."

    Get your evidence - the facts about the weight and the postage
    due amount - written in a simple to understand paragraph.

    Make sure you file within the PP time limit, but don't rush it.

    ..........

    The avenues of messing with the guy are wide, if the results
    are not in your favor.

    www.ic3.gov needs to have the story.

    The USPS needs a complaint in their file at his LOCAL station.

    ....

    I am "sure" a PP appeal would prevail, but if it did not, a BBB
    complaint against PP would VERY likely result in a "courtesy
    refund."

    don't buy stuff from folks you already KNOW are SCUMMY.

  • Thanks Storm and everyone who has given me some very good advice, I appreciate the help.
    Yes, I do work at a bank and I know we can file against un-authorized debit card transactions, I just dont know if this transaction would fall into that category or not.
    I believe,as Storm does that if I can ever speak with a live rep from Paypal or E-bay and possibly E-mail them the photo of the bubble mailer with the postage amounts on it I should have a good case.

    Thanks and we will see in the following days or weeks what transpires.

    Remember, EBAY will make NO finding in the matter.
    They will just tell the seller to "work it out." The ONLY
    reason to file with EBAY is to try to figure out what the
    guy's story will be BEFORE taking the case to PP. (And,
    often, a message from EBAY will encourage the seller to
    solve the problem.)

    If he tries to screw you, you can also file a SNAD claim through PP and send him back a package with an empty toploader...PP will credit yr account as soon as DC is confirmed...it would not be inaccurate as he send you an empty space where a card should have been...if any seller deserves to get one served rigtht back at him, this guy does..

    Contact the postal inspector for Mooresville NC. I have an unopened package from him that was intentionally shipped at a lower weight as well that I'd he happy to send to you as additional proof that this is a repeated problem.

    DO NOT HAVE ANY CONVERSATIONS WITH HIM ON THE PHONE. He tries to resolve everything via email and phonecalls so that nothing can be tracked. Send all communications through eBay directly.

    Just know that you will have to deal with him making false unpaid item claims against you as well.

    His ala carte charges for "insurance" are an EBAY violation AND
    a violation of the laws of NC.

    He can be reported in NC, and they will halt his insurance biznez, unless
    he is a licensed insurance company or an agent that writes SINGLE
    policies on each transaction.

    He is allowed to use the "private insurance" scheme, but he is NOT
    allowed to charge an ala carte fee for it. (4SC uses the scheme within
    the law, by INCLUDING the INS in the S+H price.)
