How awful! And I was feeling bad because my son fell down 4 stairs this morning at school. My prayers are with this young man and his family.

You mentioned that he was entertaining the nurses. With aspbergers, I bet he is a pretty witty kid..most who have the disorder are intelligent beyond their years.

I also feel bad for the driver.....my prayers will be with him as well.

Wow... just came back from my local hospital visiting a close friend ....due to his age and health, he does not rebound quick like the rest of us. Maybe this 12 year old can!!image to a quick recovery.

I'm very sorry to hear about this..especially angry too because it was caused by careless inconsideration...I hope he recovers fully and soon! Best wishes..

Wow...I am relieved to hear that he will make a full recovery! It sounds like his spirits are up, so that is good to hear as well. God bless!

Just got to reading through this. Crazy, man. I hope they take the driver for everything they're worth. Thoughts are with your family.
  • My thoughts go out to the injured kid. But why didnt his mother walk him to the bus stop knowing full well of his condition? She watched from the driveway? Yeah the driver was 16, but I can see who was incompentent. Am I crazy?

In California, we have California Vehicle Code Section 22454(a), which provides:

The driver of any vehicle, upon meeting or overtaking, from either direction, any schoolbus equipped with signs as required in this code, that is stopped for the purpose of loading or unloading any schoolchildren and displays a flashing red light signal and stop signal arm, as defined in paragraph (4) of subdivision (b) of Section 25257, if equipped with a stop signal arm, visible from front or rear, shall bring the vehicle to a stop immediately before passing the schoolbus and shall not proceed past the schoolbus until the flashing red light signal and stop signal arm, if equipped with a stop signal arm, cease operation.

In Massachusetts, you have Massachusetts General Laws Chapter 90: Section 14, which provides in pertinent part:

When approaching a vehicle which displays a sign bearing the words “SCHOOL BUS” and which is equipped with front and rear alternating flashing red signal lamps which are flashing, as provided in section seven B, and which has been stopped to allow pupils to alight from or board the same, a person operating a motor vehicle or trackless trolley shall, except when approaching from the opposite direction on a divided highway, bring his vehicle or trackless trolley to a full stop before reaching said school bus and shall not thereafter proceed until the warning signals are deactivated, unless directed to the contrary by a police officer duly authorized to control the movement of traffic.

The only major difference I see is that in California, you have to stop when coming from EITHER direction, but only the same direction in Massachusetts. It's a pretty serious offense to violate Section 22454 here in California, for obvious reasons, I would imagine it is the same in Massachusetts.

    Jack,

I think there is one major term that you overlooked (No, I am not familiar with Mass law). The law, as you have supplied, states that it does not apply when coming from the opposite direction ON A DIVIDED HIGHWAY ... could not find that definition in the Mass law, but I would GUESS that a divided highway is one which has some sort of barrier dividing the N/S or E/W lanes. In the video it did not look like there was any barrier, so I would say that law applies to drivers in BOTH directions in this case. JMO. What do you think?

Hey guys, isn't it BORING when two attorneys start talking to one another? LMAO

I deal with adults with Asperger's on a fairly regular basis...many of which are fully socially functioning adults with families of their own. It's much like a person with high functioning Autism. In most cases, these individuals do not need to be babied. In fact, over-protecting individuals with Asperger's is probably a bad thing, as it could further stunt their social development.

Excusing the carelessness of a 16 year old driver, who was just that--careless--isn't the answer here.

This is just terrible news. I pray our Lord brings your nephew back to complete health and can comfort his pain during his recovery. Please keep us posted as he progresses.

    Brian
  • again thank you for all your support. Got an update this morning from his Mom.

He is resting in ICU, constant monitoring, blood pressure is a little low, breathing is labored due to broken ribs and surgery, but he is stable.

and for the moron who posted this:
"But why didnt his mother walk him to the bus stop knowing full well of his condition? She watched from the driveway? Yeah the driver was 16, but I can see who was incompentent. Am I crazy? "

yes, you are crazy, he is a very high functioning kid, probably smarter than you image the Aspergers just makes him a little shy and withdrawn. His wit amazes me and his courage has blown me away.

It simply amazes me how anyone can post this type of comment- there is no need for it! You may think that which is understandable but to post it in a thread when a member is simply asking for a few prayers and well wishes is completely unnessesary.

You are more than crazy here- you are very ignorant as well.

(Folks have been being educated about the disorder via the TV-show

syndrome. He's the one with the physical tics and super-funny trial tactics.)

  • got an update and some good news!

My nephew is OUT of the Intensive care unit and into a regular room. Spent the morning with him and his Mom and they are both doing FINE. He looks beaten and bruised, got a leg brace and a cast and Iv's running in and out of his legs (couldnt tap any veins in the arms) But the TV is distracting him (cartoon network!) and he politely asked if we could stop talking so he could enjoy his show.

Thanks again guys for your support.

  • That's great news Ichiro, thanks for the update....Hopefully, he will be home soon, the hospital food is too bland...maybe you can sneak him in some good old fashioned junk food image

Now be quiet, the Cartoon Network is on LOL!!! image

Very good news indeed! Hopefully the only lasting result of this awful accident is a pretty cool story for him to tell his classmates.

He sounds incredibly brave and has amazing empathy for his age to be so concerned about others and do what he can to make them smile during a time like this.

Continued thoughts for a speedy recovery.

  • Updated with some excellent news:

the little guy is on his way home; he's using a walker to get around, which is an improvement; looks like the spleen is not gonna bounce back, so the gave him some innoculations to cover infection. Mom is thrilled of course! And when he gets home he will have a stack of YugiOh stuff to keep him busy :0)

    thanks guys!
