Paypal found in my favor, but no money to collect.....

Bought a non-ebay item from a seller (item originally listed on Ebay), paid via paypal and never got the item. Opened dispute, found in my favor but paypal said no cash to collect. Should I do a chargeback to my credit card? Seller has never responded to me or paypal.....

This is my first paypal related problem so not sure if there is anything to do. Item was $150.

  • Just because paypal found in your favor does mean you will get your money. Had a guy scam me for $600.00. They found in my favor but could not get money and then called it quits - close the case and no additional effort to get money beyond that.

    I visited the guy in person and got my money when he realized I knew where he, his wife and kids lived. This guy is still scamming people. No guarantees with paypal no matter what they say.

    What does paypal do if you file a chargeback with your credit card company? Are you burning a bridge? Some of us can't throw paypal under the bus whether we like them or not. --jerry

    I wonder the same thing but this is my first problem with them or my credit card. I called the company and filed the chargeback.

    Thanks for the help, now I know to call the CC first if this ever happens again......

    I don't know and I'm not going to find out the hard way. I have full trust that PayPal, when in any doubt whatsoever, will screw the buyer. That's why I always pay by C.C.

    Based on my recent experience, PayPal does not care one bit about anyone. They are a machine. Best course is to file a police report, then a lawsuit. You might give Judge Judy a call. I am currently doing those things. Paypal told me to go pound sand even though I provided them legal evidence that the buyer was a lying. My district attourney said they could file charges on the guy scamming me but the cost to extradite him back would be too much and they wouldn't move forward... So, off to court I go.

    PS. Paypal does a "best effort" to get your money back for you according to their supervisors.

    I would throw PayPal and ebay under the bus any day of the week.

    Forget the lawsuits...for $150 they'll laugh at you.

    File the chargeback and forget about what paypal will do. if they close you down, open up another account....if you really need one.

    Why let a scumbag take your money with Paypal's help???

    I'd like to hear some details about this, such as: how much money is at stake, how far away the other party is, and what evidence you have.

    I foolishly used a bank account to fund a paypal payment back in 2006. Law enforcement would not assist even though I paid $3251 for the coin. I just joined the Steele v Paypal class action suit. I doubt that I will see much but Paypal stonewalled me all the way so this is better than nothing.

    PayPal wants you to go through them first. They state that if you do a charge-back through the CC company they will stop their investigation. Since they obviously didn't solve your problem, file with your CC company ASAP.

    I would go through the PayPal system first and then do the CC. I had the same situation a few months ago and ended up getting all my money back through PayPal. I don't know if going through the CC first would have affected PayPal but you have plenty of time to have the CC reverse chargers.

    This confuses me, paypal buyer protection doesn't/shouldn't have anything to do with paypal being able to collect from the seller. If you lost money and did not receive the item, the responsibility lies on paypal to reimburse you under the buyer protection and then paypal can try and recover their loss. I admit I am not an ebay expert at this, and maybe somewhere this is covered in the fine print.

    As said above, file the chargeback!! Was the item covered by paypal buyer protection?

    “PayPal” is all about paying them. They are not your “pal” when it comes to collecting from crooks and deadbeats.

    They are truly a “non value added service.” They charge a fee to do something that can be done free, then stiff you if there’s a problem. Great business model – right out of the Warthen School of MBA-land.

    From what I understand Paypal won't do the buyer protection thing unless you press for it.

    This is how it is supposed to work.


    1.......you file claim with PP if they find in your favor they take money from loser.

    2......If no money can be had from loser Buyer protection kicks in (in various degrees) 200.00 up to 2000.00 depending on seller.

    PP buyer protection kicks in ONLY if you press them for it.

    3.......CC chargeback (if you were smart enough to fund the transaction with a CC)


    4....CC says NO to chargeback or you used paypal funds or bank account (you visit scammer and threaten extreme bodily injury)

    5......About the time you are coming out of jail he is coming out of his coma and you repeat step 4.

    There is no buyer protection outside of feebay.

    Per the OP, this was a non-eBay purchase. From PayPal's user agreement:

    13.1 How am I protected if I have a problem with a purchase?

    PayPal has two programs to help protect you:

    -PayPal Buyer Protection (for eligible items purchased on eBay)
    -PayPal Buyer Complaint Policy (for all other items purchased on or off eBay)

    13.5 PayPal Buyer Complaint Policy

    What is the PayPal Buyer Complaint Policy?

    It is PayPal’s process to help you resolve a problem with a seller through the PayPal Resolution Center for purchases that are not eligible for PayPal Buyer Protection.

    The PayPal Buyer Complaint Policy is similar to PayPal Buyer Protection in that it enables buyers to file Disputes for Items Not Received (INR), or for items that are Significantly Not as Described (SNAD). However, recovery of any amounts is not guaranteed and is limited to the amounts that PayPal can recover from the seller’s Account, even if PayPal makes a final decision in your favor.
