What do I do with Paypal...got a card with tampered case...help!

Hello everyone,

I got a card in the mail today that clearly has a case that has been tampered with. Total price paid with shipping and insurance was $292. Card was sent with insurance and delivery confirmation.

Seller has lousy feedback...probably should not have bought the card. What is my best approach relative to paypal for making a paypal claim to have money refunded and return card to sender. I do not want to send card back first without money.

Thanks to all in advance

Jeff

Got a scan you can post here?

You can file a SNAD claim at PayPal.

They will make you send the card back, and then refund your money...
up to the amount of "seller protection" offered.

If the seller has $2K of SP, you get a full refund.

If the seller has $2C of SP, you get $200.00.

If you paid via credit-card, the CC-co will make-up any deficit.

I think you will need signature confirmation for when you send it back too.

    Good for you.

Jeff can you link us the auction?

also, I would (well maybe) contact the seller first.

I could not tell anything from the photo, BUT the seller
may claim it was damaged in shipping.

That changes nothing in terms of the SNAD claim.

Make sure you make hi resolution scans of the card for your records. In case this drags out...make sure you save a ebay auction page and papyal details on your computer.
Do not send card back until told to by paypal. and when you do send insured and with signature conformation.
check on this as value is over $250......there might be a paypal requirement beyond delivery confirmation.

First inform seller your intentions. He might just want to skip all the mess.

Jeff did you at least notify the seller first of a problem?

Did not notify seller first. I normally would, but with lousy feedback, decided to skip this step. I do not want to get into "send it back and then I will refund" your money.

    Very bad move.

If a buyer filed a claim against me without first trying to contact me and work things out, I would be seriously pissed off and would fight the claim tooth and nail, especially as I usually give refunds with no questions asked.

No matter what the seller's previous feedback, you should always notify them when you are dissatified with a purchase and see how they respond.

Agree with Matt as you can always file a SNAD.

Even after speaking with the guy you could have done that.

That is usually the "academic" advice I give, too.

FIB and I are both good sellers, so we want/deserve a chance to solve
    problems.

But, sometimes, the buyer has a "feeling" that trying to deal
with a bad-guy is not worth the trouble.

A slab that has clearly been opened and closed up, is not likely a good-faith mistake.

The other problem you have on Ebay is that there are plenty of people who make completely innocent mistakes. The fact that the case has "clearly" been tampered with (according to the OP), doesn't not necessarily mean that it was tampered with by the current seller of the item. Many bad cards/slabs/packs get passed around and have multiple owners before the end up being bought by someone knowledgeabe enough to notice that something is wrong with them. There are also many sellers who are not that knowledgeable about cards and/or who list so many items that they do not examine them carefully before listing them.

So while I know we have been somewhat conditioned to believe that every seller is a rip-off artist, many mistakes do truly turn out to be innocent. I've bought two cards that turned out to be trimmed recently, and in both cases the sellers gave me a full refund and said that they had not even noticed that the cards were short when listing them.

This thread is worthless without pictures and auction link. You still should have contacted seller first.

The seller made a mistake by not sending it via signature confirmation.

Not sure how that can help you.

I do not think every seller is bad.

There are MANY more bad buyers than bad sellers.

    ............

When a guy says he can open the slab with his fingernail,
the presumption of "innocent mistake" is on thin ice.

Storm i agree and hear you, but couldn't the buyer file a snad after speaking first with the seller?

It's not like speaking first was playing his hand.

Either way you can file even if the seller is amicable.

Yup. I would have contacted the seller.

However, the OP had other info that he chose not to post on the tampering issue.
If I was an "ordinary buyer," I might not have wanted to chat-up the seller either.

    The OP asked:

"What is my best approach relative to paypal for making a paypal claim to have money refunded and return card to sender."

When a buyer believes he has been defrauded, it is not always helpful to offer, "contact the seller first."

MOST sellers deserve a chance to fix a problem. Maybe not ALL sellers.
