I filed complaint with Paypal - Look at the email they sent me

After careful review, we have concluded our investigation of the Buyer
Complaint described below.
We have decided in your favor, however, we were unable to recover any funds
from the seller's account. As stated in the PayPal User Agreement, recovery
of funds associated with a Buyer Complaint cannot be guaranteed.
Please know that we will make our best effort to recover the funds in
question if they become available in the seller's account in the future and
will take appropriate action against the seller. Such action may include
issuing a warning, a temporary restriction, or terminating the account.
Keep in mind that PayPal uses a number of factors to determine when to take
action, including member complaints. Due to privacy laws, we cannot discuss

That means the seller does not have any money sitting in his pay pal account that Pay Pal can get their hands on. It sounds to me like they are waiting for him to complete multiple sales, have that money hit his account, then they will try to grab it... you should verify that and keep on top of the situation when you see him sell a large auction or group of auctions.
Also, yes... as others have said, contact your credit card company.

Probable with waiting is most likely his account is locked out, so nobody can pay him either.
I ended up calling them and they said, that since I was a "valued" customer they would send the send a credit of the full amount and go after the other guy on there own time.

I think you took him the wrong way ??? He was trying to say what paypal was thinking in the matter.
I thought PayPal covered you up to $200 on eBay purchases regardless of the seller's account balance????

PayPal claims the email is a "glitch;" it's not.
The new policy is to try to collect the cash from the bad actor
BEFORE issuing the refund. The refund is routinely made
about 10-days after the goofey email is sent. But, MANY folks
find it necessary to call PP on the phone to solve the problem.
PP hopes that THOUSANDS of folks will just forget about it
and they will not have to pay. There is NOT ONE report of
anybody not getting their money, AFTER they called PP.
Getting your CC company in the mix at this point is a bad idea.
It is not necessary; save it for when/if it ever is.

Sounds to me like PP found in favor of the OP in a chargeback dispute, but PP is claiming the OP is SOL because there wasn't sufficient funds in the account to make the OP whole.
Hence the talk about going directly to the CC company. The worse PP can do is cancel the PP account, I think. And after an episode like this, it doesn't seem like a punishment. I'm thinking about canning my PP account anyway.

The policy may be new, but the result isn't. The EXACT same thing happened to me 2 years ago, and I got an identically worded email. I had paid with a balance, and was out $170, and am to this day. IMO, there IS NO buyer protection. File with your CC as others have suggested.

PP "Buyer Protection," to the coverage limits of the debited account, as recited in the UA,
is in no way contingent on the balance in the subject debited account.
If the coverage is $200, and the loss is $400, the claimant is paid $200.
If the coverage is $2,000, and the loss is $3,000, the claimant is paid $2,000.
I assist folks in filing claims everday and I am very familiar with the process.
PP is a RICO-Enterprise, BUT their buyer/seller protection schemes have
NEVER been publicly reported to have defaulted on a granted claim.
OFTEN, telephone contact is required to resolve claim issues.
