Is this forum considered the "media" in the context of Noe's appeal of his Ohio conviction

Everyone thinks the life of an international tax lawyer is all glamor-- traveling to exotic locales, dining at the finest eating establishments around the globe, and the ever present onslaught of Tax Groupies and paparazzi, who follow us around, continually trying to get an autograph or photo. The reality is that it is Friday night, and I am alone in my hotel room in Beijing reading Coin World. image

In the recent issue, there is an article about ex-dealer Tom Noe, and the fact that he is appealing his conviction in Ohio. One of the reasons why his lawyers are seeking a reversal of the conviction is as follows: "Overwhelming negative media against Noe before and during the trial deprived him of a fair trial."

I know that we discussed the Noe case on these boards to a great extent. At one point, there was no less than a full page worth of threads on the issue. In your opinion, are these boards considered "the media" in any form, and might they have had an impact on Noe's trial (or at least had an impact on the perception of Noe before and during the trial)? We have a lot of experts on these boards, so I don't think we can immediately discount the impact that we might have. What do you think?

    Yes there was negative impact, because it was true.

    Now if his verdict was influenced by lies, he might have a case. But IMO, there is no case. There was negative impact because he performed negative actions.

    Longacre, try some of the full service Karaoke, then you won't be so lonely. I have an office in Shanghai, but don't get to Beijing at all.

    And while forums might be considered "media", I doubt these had any impact at all.

    Agree.

    Methinks his lawyers are after the Toledo Blade, who essentially broke the story and followed it to its conclusion. Sour grapes.

    I didn't think they even knew how to get on the internet... but were going to learn how to do it someday soon....

    No disrespect to this forum, but...

    Honestly, I don't think this forum is large enough to have an impact on a pool of jurors.

    If the lawyer was concerned about the impact of this forum, the lawyer could have asked "are you aware of the Collectors Universe forums on the internet" during jury selection.

    To argue that this forum has a general impact on the American public and could poison a jury pool? That's a stretch and I don't buy it. HSN has more of an impact, unfortunately.

    Is the forum media? Yes.
    Is it "media" in the context as used by Noe's lawyers, i.e., is it what the lawyers were referring to that prevented Noe from getting a fair trial? No.

    This forum is not media in the sense that television, newspapers, radio or magazines are considered media. Certainly it is a medium of informational exchange - however, it does not have the exposure of even a city newspaper... So, no, it would not even wiggle the needle of 'media'. Cheers, RickO

    I wasn't collecting coins at the time, but I visited his shop in 2003 and 2004 when I made my annual trip to Toledo. At the time I was spending way too much money on trading cards and when I left his shop he had more money and I had less.

    When this broke my mom followed it on the Blade (she reads it daily online) and we were both quite surprised when we found out that we had both been in his shop.

    The appeals lawyers are most likely referring to the repeated stories in the Toledo Blade newspaper (which, I believe, had the first investigative piece about an Ohio state agency investing in rare coins) and all the subsequent coverage for more than a year by other Ohio newspapers, the Associated Press and radio and television stations.

    PS: Longacre, while you're in Beijing, it means there are several dozen fewer paparazzi chasing after Tom Cruise and Paris Hilton......

    Curious about the extent of the media coverage, I just did a quick Nexis search for the terms "Tom Noe," "coins," and "Ohio," and limited the search to "U.S. Midwest Regional Sources" in the news media the past five years. I got over 2,200 hits.
