Have any of you experience with someone who fraudulently utters a United States coin?

Whoever fraudulently possesses, passes, utters, publishes, or sells, or attempts to pass, utter, publish, or sell, or brings into the United States any such coin, knowing the same to be altered, defaced, mutilated, impaired, diminished falsified, scaled, or lightened; Shall be fined under this title or imprisoned not more than five years, or both.

I guess I shouldn't try to sell any mutilated coins on eBay anymore, but can't I still utter?

  • 3: to put (as currency) into circulation; specifically : to circulate (as a counterfeit note) as if legal or genuine <utter false tokens> From Webster online dictionary image so no, not a good idea to utter!

On the off (judging from the quality of your posts I think very off) chance that you are asking a serious question...

It does if you fraudulently claim that the coin is worth a different amount with the chopmarks then the coin would be worth without them.

If the coin is legitimately worth a premium because of the chopmarks then no, it is not illegal to utter it.

Sounds like in the eye of the law....spending a circulated coin could land you in the slammer for five years.
