Help needed to recover a $3,542.75 stolen coin. UPDATE 1/17 - Coin has been returned.

  • Maybe you can file a criminal charge against him, even if law enforement does not follow up. The guy might decide to pay up or return the coin, if he hasn't sold it already. I know from experience, small claims is a fairly straightforward procedure in NC.

    Watch his eBay ads closely...

  • Someone mentioned small claims court. At over three grand I'm thinking more like felony theft. His ignoring your many attempts to contact him speaks volumes about his culpability. If he felt there was some mistake, he would have responded by now in an attempt to resolve the situation.

    I would also caution a face to face encounter with someone you don't know. Peolple get badly injured that way. Go with reporting this, with your documentation, to the police.

  • Can you search the PCGS registry for that coin? Notify PCGS if anyone tries to enter that coin into registry, then you'll know who has it??

    There is a person on the Forum named Johnny Mondo or something like that who runs a collection service. I would contact him for suggestions as to how to proceed.

    Currently going through something similar to this as well. I've been grossly underwhelmed by the inaction of all officials.

    The best course of action is to get the police involved if they will take it. In my case both my local and the remote police would not act (no technical theft since I sent a good check to the proper address). The USPS is worthless because now they have you file an internet claim report that gets pookaed with a zillion other never to be reviewed claims. The civil suit would be a farce since your chance of recovering $$ in a judgement is minimal. Basically, your local officials would just hope that you go away.

    Either go with the police or the leg breakers. Spew the person's name to every dealer you can think of in North Carolina and across the country. Advertising can't hurt.

    If the person is a member of ANA, you have to be too for the ANA to take full action....otherwise they send a letter of inquiry and then let it drop after that.

  • Leave him a message stating that at this time you consider the coin stolen and will be contacting the police if he does not reply and pay up in X number of days.
    That should do it, and if he ignores that message, you should contact the police right away. Stealing a coin worth over 3 grand is not acceptable and needs to be reported.

    Out the guy here and hopefully some pressure will be put on him from others that do business with him. If he is still selling on ebay I think bids on his stuff will dry up. If he is still buying he will find himself blocked by many. Collectors/dealers at shows will stop doing business with him as well. The coin community is really pretty small and the word will spread fast. I hope you out him before he gets another forum member. Outing him is probably your last resort before you turn the recovery into a full time job.

    also wanted to mention I had a similier thing happen to a forum member a few years ago. I sent him a few coins on approval over a few months time and he bought them or returned them. I trusted him so I sent him a group of certified toned Morgans. After about three weeks with him not contacting me I tried to contact him but no response over the next few weeks. I searched the forum and found out he was posting here but I never got response to my PM's. I started a thread about the situation without naming him but said I would if he did not pay fo the coins or return them. He got wind of the thread and took care of things right away and had a lame excuse that he got too busy. Maybe email him a link to this thread first.

    Well, I'm happy to report that after a series of written legal threats regarding Class B felony charges and civil lawsuits, the coin has been returned. I still haven't heard from this person, but at least the coin is back in my possession.

    I would like to thank all who took the time and effort to provide me with reasonable suggestions to recovery my property.

    The buyer certainly looks bad in this situation. To not even offer an explanation for the delay is troubling to say the least.

    One question, in the OP, you mentioned that you got approval to buy the coin at a show a "few months ago" but sent the coin 6 weeks ago. Makes me wonder if the buyer fell on hard times in the interim. Doesn't excuse his conduct but might partly explain it.

    I could see if he had a heart attack or something serious but evidently this is not the case.
    Theft still isn't ok even if the merchandise is returned at a later date.

    Glad to hear this story had a happy ending. Must have been the popcorn. Anyway, isn't there an old rule that unsolicited items received in the mail do not need to be returned? Under the rendition of facts I can see why the seller was worried. It was not as though the buyer initated the mailing of the coin. There was apparently a huge gap in time between when the seller talked to the buyer and when he eventually sent it to him.

    XXXXXXXXXXXXX Good the coins is back. And I hope the guy isn't a jerk but jut ran into some major emergencies

    (wife with uterine cancer, son out on $300000bail for drugs, etc===stiff that's private that took all

    his awaking hours.

    At least in Washington DC he would have commited a fraud or theft by deception, and " DC Bunco"

    would vigerouslly persue him. The case is too large for small claims buy if you have your check/purchase draft

    and the registered mail reciepy, in the future if this happens

    your attorney files what's called a "motion for comversion" followed by a summery judgement in either binding arbitration

    or a bench ruling. In no case can you just take take coins without ending up like OJ Simpson in jail

    for just grabbing his memorabilia in a Vegas hotel.

    What really happens is the judge issue judgement yo you or a clerk escrow to protect them. Then a date is set for U.S. Marshalls to enter the man's house
    . If not given the coins, they take him intread, for contempt of Court, and he rots in jail until

    you either get the coin or he pays in cash for the coin and interest you payed for businees capatal loans.


    #######Note: I just prevailed in a conversion suit for coins taken by a relative.

    Checks, reciepts, and certification serial numbers was ownership proof to preponderance of the evidence.

    I've actually listed the coin on eBay already, so I wouldn't want to be accused of spamming the boards.

    The bottom line is that if he ran into financial trouble, etc., all he needed to do was let me know. Just maintain contact and it would have been fine. But he didn't. He disappeared. He didn't reply to any of the half dozen e-mails I sent. He didn't answer his "business" phone number (the one registered with eBay {invalid contact information can be reported by anybody.. hint, hint}) any of the over 100 times I've tried to call in the last 2 weeks or so. I've even had people try to call the phone number from Florida, Nevada, and North Carolina and there has been no answer every time.

    That's just not the proper way to do business.
