Not only didn't this seller put OC in the title, but he/she doesn't put it in the description either. This jackass even paid for a subtitle to give the low pop numbers of the card. I hope no one sets a snipe without looking at the scan because thats the only place to see that the card has an OC qualifier.

1955 Topps All-American #16 Knute Rockne PSA 8
There so many inaccuracies, my head is spinning.
It's malicious misleading.
BOOOOOOOOOOOOOOOOOOOOOOOO!

If someone buys the card without looking at the scan, they deserve what they get. It IS a PSA 9. He just neglected to list more of the details.
Arm's length, buyer beware, etc.

The card is not a mint 9 card, nor is it a 1 of 8
Card not as described.

Everything in life isn't cut and dry. Yes, the buyer should look at the scan but that's no excuse for the Seller to try pulling a fast one.
It's false and intentionally misleading advertising. A PSA 9's value is different from a PSA 9 OC. By stating this is a 1/8, he is representing it's a 9. Per the prop report, there's eight 9s and four 9 OCs.
Since you have "esq" after your name, I assume you are a lawyer? If so, you should know better.
<< <i>If a person bought that Burda card for true 9 money he/she would not be obligated to complete the deal.

But the picture certainly describes the card perfectly. If there's a conflict, the buyer should resolve the conflict before buying.

Yes that is true, what happens if the photo is red x'd out? Certaintly that can happen for those that self host.
Card is not as described, therefore a person would not have to complete that deal if he/she chose not to. And if they did choose to I would imagine ebay/paypal would back them too.
Whatever happened to the 'meeting of the minds' spiel you used to advocate? Surely they are not meeting in this case.
