Coin rcvd is not one in auction photo... v.7,987.02b
What to do next with this midnight seller? PCGS-graded 57-D Frankie is not one in auction photo; serial number isn't the same, but is close. However, a -9 shouldn't be confused with a -4 in the last digit of a serial number, should it?! I'll figure out something to do with this bad seller, I'd appreciate some ideas.

Is it worse than the coin pictured?
Was there any "coin you receive may not be the one pictured but will still be PCGS and same grade"?
I've been told I tolerate fools poorly...that may explain things if I have a problem with you. Current ebay items - Nothing at the moment
If the coin is just as nice as the one pictured and the only material difference is the single digit, it might not be worth getting into a pissing contest over.

Auction in question....
Looks like the one in the auction photo does have some "milkspotting" on the lower portion but it still looks better than the one you scanned.

<< <i>I had convinced myself those "milkspots" were on the plastic, not the coin. As an example, in this case, how do you try and differentiate the layer of plastic and what we see on it, compared to what appears on the coin in a photo, a few millimeters "deeper" in the 2-dimensional view? >>
No problem on the help....you are new to the forums and learning your way...soon, you will be the one helping others
For the "milkspot" item, I think it is a learned trait to notice them. I am sure many others are better than I am at spotting coins with them, but those definitely look to be on the coin and not the holder, imho. I've seen worse though.

"You received an item exactly as described in a sealed PCGS holder. Your only issue is that we used a stock photo."
I can't believe the guy expects me to believe that his stock photo of a Frankie just happens to be the SAME date and mint mark I wanted to buy, AND that his stock photo was 1-digit off from what he sent me.
I guess he thinks he only deals with people incapable of rational thought. Not that I always think rationally, but you get the idea don't you?!
How can sellers like this be stopped?
<< <i>I received this in an email from the seller today:
"You received an item exactly as described in a sealed PCGS holder. Your only issue is that we used a stock photo." >>
Usage of a stock photo is not indicated in the auction that I can see anywhere. So this seller's CYA falls on deaf ears.
did you ask for a RA#?
did you state your displeasure in that it was not clearly stated that stock photos were used?
demand a full refund including shipping and insurance in that coin received is not as good as coin shown
leave feedback stating your displeasure on stock photos

My input:
I purchased a coin from this seller and to this day he has not left feedback although I did for him. Despite him claiming he will be out on vacation, this may be so but he sure as hell, he answered a question LAST NIGHT regarding a transaction made approximately a Month ago, so this BS about being "on vacation" and "complletely automated" is exactly that ... a load of Bull s#!+ - OK!
MY Opinion (for what it is worth)
Open a dsipute:
At the botttom of every listing there is a link for doing so, Item Not As described. You have irrefutable/ indeputable Proof Positive.
Report him to eBay and if you paid using PayPal, start a dispute there as well and be certain to have a photograph of the listing you bid on (complete w/ cert #) and produce what you have produced here in the way of pix, his invoice & as much material as you possibly can muster then go about getting a refund per the proper channels. Then. without any threats, simply use the ask the seller a question feature FIRST followed by an email to him, CC to yourself complete w/ pix. From there get the ball rolling with Item NOT as described or shown and egt all your money back along with forcing him to adhere to the terms of his very own binding agreement. This should solve your problems.
I don't like the guy's attitude and very seldom does a seller actually piss me off but this one HAS. because of his ATTITUDE. Rest assured that I will NEVER buy from him again and will take EVERY opportunity to tell it like it is due to his cavalier attitude
HE IS IN. NO DOUBT ABOUT IT - VACATION OR NOT and this IS a binding contract. We have ALL seen PayPal come thru for buyers time & time again. Use all that you have against him and work the system to the "T" thereby FORCING him to abide by his own terms as stated. He must refund your money - ALL OF IT - and by his own words, will even cover the cost to ship this POS back to him!
Good Luck & I hope this helps. If you run thru the paces you'll come out just fine. I would commence a dispute and a chargeback IMMEDIATELY!

That link also says:
Pictures: WYSIWUG! Thats right, What you see is what you get. For the most part I do not use stock photos of similar items, each one is for the exact item up for bid (Only exception is some modern commemoratives and some low price coins). I do NOT enhance, color correct or touch up my pics in any. I do enlarge them to show you some detail, but that's it.
So how do they define "low price"? One person's low price is another's king's ransom...

I think you have a claim if you paid by paypal.

Oh well, I'm back in the Frankie market! Now I've just got to find out about the two I ordered from the fellow who supposedly died a few days after my order...sheesh!

<< <i>This guy is a real slime-ball. I got some of my money, but not all of it refunded. He misleads in his ad about that too. He didn't refund my shipping costs for his misrepresented item. What a pathetic excuse for a ____ (Russ, please insert your powerscrewer icon!) >>
So you already agreed to the partial refund and shipped the coin back?
Too bad. Lesson learned, I hope.
