What irks me even more in this case, I was at a loss in this transaction right from the start... At the time I was just trying to dump some modern proof sets that had gone down in value, and was grateful to get the amount I originally paid for them. Had I thought there'd be any problems at all getting paid promptly, I would've just kept the stupid proof sets and not bothered. I sent big shipments of proof sets to 2 other dealers that day, and those buyers paid me promptly and in full, no hassles whatsoever. But all it takes is one of these jerks who tries to rip me off that makes me not want to pursue this kind of business anymore. It's very upsetting to me. -Rick >>

Just to clarify this, I did NOT just ship the coins and do absolutely nothing for a whole year; I HAVE maintained an active communication with the buyer. He does respond to my emails, BUT I keep getting the run-around ("will try to send payment in a couple of weeks..." etc.) I tried to give him the benefit of the doubt, assuming maybe he's having trouble making ends meet, whatever. But time flies by, I get caught up in my own busy life, and I put the problem on the back burner. That's my fault. It doesn't even seem like it's been that long, but sure enough I have the copy of the invoice right in front of me and it's dated 2/28/06.
It's worth mentioning that some dealers are just notoriously slow when it comes to processing shipments. For instance, a dealer I do business with in Covina, CA typically takes 4+ months to process my shipment and remit payment, but they're honest and you know though it may take a while, you're not going to get screwed over so I don't complain. Am I wrong?

I am sure you are aware of this, have learned from it, and really don't need to be reminded over and over that it could and should have been done differently. Most of us have done something similar at one time or another, including myselfl and I am a damn lawyer. I got hit on an ebay item a couple of years ago for a few hundred bucks and never received the item I purchased. I waited awhile, went through the appropriate channels with complaints to no avail, eventually just letting it go (which was very tough to do).
It is obvious that you have learned from it and, if you want, pm me and I can recommend some things you can do to beef up your transaction documentation that might give you a bigger hammer against non-paying guys like this.

i would start a new thread with this losers name in the title to get his attention and to hopefully avoid other people from getting scammed. i certainly would never be afraid of someone suing me for anything. state the truth, dont embellish and play hard ball. i have been sued unjustly. no big deal. life goes on. now if the above doesnt get his attention, start dating his girlfriend or wife. that will get him to notice you.

Good grief -- the OP is worrying about being SUED for airing these facts in a public forum? He seems to have a mindset that all but admits defeat -- after putting up a minimal fight. It's also notable that he sees his only recourse in a lawyer, which of course he assumes is going to cost soooo much money. That's learned helplessness at work. (That outlook is also evident in reluctantly giving up the name under pressure, just to satisfy some posters.) But kudos to him for looking for advice.
There's not much to add here, except to just drop the defensiveness and get to work. (You know the guy has been yanking your chain for a year.) I question the wisdom of the threats made here -- there are alternatives that are probably easier for the OP -- because if anything is going to help the deadbeat to weasel out of this, it's the use of physical threats to resolve an outstanding debt.

I most certainly WILL contact the Numismatic News advertiser fraud department and file a formal complaint. Chances are, someone else has gotten screwed, or could get screwed in the future, by this guy.

It's worth noting I've done a lot of dealings throughout the years, and almost NEVER had any problems like this like some of you have. Maybe I'm just lucky, I don't know. It's fairly easy to make money by selling something that hasn't been paid for. It's a bit more difficult when you have to pay for the stuff.

Excellent idea. Plus tell him that he has been outed here, that the guy near him is going to badmouth him at the coin show, plus file charges against him through the P.O. and his local police district. If you make it uncomfortable enough for him, he will probably pay you. But only if you make it uncomfortable enough that he decides it's worth paying you to get him off your back. Put the load on his back, and take it off yours. A famous coach (I forget who) said "the best defense is a good offense". Go on offense! (But stay legal.) And good luck.

As suggested by several members of this forum, I had mailed Mr. Hancasky a "Final demand for payment" letter explaining exactly what's going to happen if he doesn't pay up immediately. This is the actual response I received:

Tell him you don't really care about his personal problems, and that you are a more important debtor to him than anyone else, ancluding $#%^$ AMEX. Then have a local board member go over and "meet" him
cash the check with his associated national bank for the cash, DO NOT deposit the check into your account.
your looking for a bigger headache with a bounced interstate check.
If the associated bank says he doesn't have enough funds, or if he doesn't have a national bank, open up an account at his bank, call them up, transfer some money $20 into a savings account and ask for some deposit slips from the bank, then deposit the check into your account with them. Then you have proof in his state of the fraud.
I'm telling you this has worked with excellent effect (or is it affect) for me. (sorry scammers)

Truth is an ABSOLUTE defense to any potential claim of defamation/business disparagement unless there was some type of confidentiality or non-disclosure agreement in place.
There's not much to add here, except to just drop the defensiveness and get to work. (You know the guy has been yanking your chain for a year.) I question the wisdom of the threats made here -- there are alternatives that are probably easier for the OP -- because if anything is going to help the deadbeat to weasel out of this, it's the use of physical threats to resolve an outstanding debt.

Yes; I'm aware of that. Obviously this guy's not a big-time dealer or anything like that... just a nobody who's trying to make a few bucks buying (or in my case, stealing) proof sets and breaking them up to sell as singles. Besides searching Google, if you search the Numismatic News online classifieds here: http://www.numismaticnews.net/Default.aspx?tabid=480 for keyword "Hancasky" you can see his most recent buy ads.
I most certainly WILL contact the Numismatic News advertiser fraud department and file a formal complaint. Chances are, someone else has gotten screwed, or could get screwed in the future, by this guy.
Thanks again for all the advice... even for the criticisms. I understand where you guys are coming from. It's worth noting I've done a lot of dealings throughout the years, and almost NEVER had any problems like this like some of you have. Maybe I'm just lucky, I don't know. Was I naive and in denial that someone was intentionally ripping ME off? Yes, absolutely. Will I be so trusting in the future? Nope.

It's fairly easy to make money by selling something that hasn't been paid for. It's a bit more difficult when you have to pay for the stuff.

Excellent idea. Plus tell him that he has been outed here, that the guy near him is going to badmouth him at the coin show, plus file charges against him through the P.O. and his local police district. If you make it uncomfortable enough for him, he will probably pay you. But only if you make it uncomfortable enough that he decides it's worth paying you to get him off your back. Put the load on his back, and take it off yours. A famous coach (I forget who) said "the best defense is a good offense". Go on offense! (But stay legal.) And good luck.

As suggested by several members of this forum, I had mailed Mr. Hancasky a "Final demand for payment" letter explaining exactly what's going to happen if he doesn't pay up immediately. This is the actual response I received:

The best I can do right now is send you 3 checks to be cashed somewhat in the future, so I can put more money into my checking account, so they will clear. Each check will be for about 1/3 of the amount owed, $654.41, $654.30, and $654.52. I will date them to be cashed when I believe I will have enough money for the check to clear. The first will be dated March 23rd. The second will be dated April 6th. And the 3rd will be dated April 20th.

I'm glad he had enough sense to respond, but needless to say I have no sympathy whatsoever for him or his debts. Now it's all about whether or not these checks are actually going to clear at the times he says they will. Wishful thinking?

your looking for a bigger headache with a bounced interstate check.
If the associated bank says he doesn't have enough funds, or if he doesn't have a national bank, open up an account at his bank, call them up, transfer some money $20 into a savings account and ask for some deposit slips from the bank, then deposit the check into your account with them. Then you have proof in his state of the fraud.
I'm telling you this has worked with excellent effect (or is it affect) for me. (sorry scammers)
