XF40, but I'm getting the impression from the smallish picture that there may be some swirly cleaning lines to the left of the date below the eagle. As a matter of fact, the whole area beneath the eagle looks funny(?cleaning), but it's pretty hard to be certain because of the size of the picture.
also i love the above average eye appeal of this coin looks original unmolested example and also with much original orange coloration and also an even skin to the coin
EF-40 sharpness for sure. There could be some surface damage or smoothing under the eagle, but it's probably the odd angle of the picture.
Retired dealer and avid collector of U.S. type coins, 19th century presidential campaign medalets and selected medals. In recent years I have been working on a set of British coins - at least one coin from each king or queen who issued pieces that are collectible. I am also collecting at least one coin for each Roman emperor from Julius Caesar to ... ?
Every PCGS AU coin I've looked at isn't AU, so I'll guess AU50 even though it looks 40.

Details 40 at least. Evidently some luster remains; could be better than that. I'd want to see it, though -- the aforementioned swirlies could mean trouble.

The angle and size don't help, but it looks like a nice 40
