This guy bid on and won my Auction (over a month ago) but he never paid for it.
Now he has copied my auction word for word and is using the pictures from my auction to resell the Mercury Dimes in his Auction.
Yet, he has never paid for nor received these Mercury Dimes from me. He has refused to respond to numerous Emails from myself and Ebay.
Now he apparently is going to complete our auction while at the same time conducting his Auction of what is technically still my lot.
So, should I tell him that, since he never completed the purchase and refused to respond to numerous Emails from myslef and Ebay, I sold the lot and it is no longer available? Then let him have to deal with the winner of his current Auction?
And yes, it may be petty on my part, but I am sick and tired of this type of bidder.

UPDATE:
Well, I got the response from Ebay, all they did was delete his fraudulent auction. They will not sanction him in any way. So much for Ebays fraud protection, apparently if you are a regular seller your fraudulent acts are ignored by Ebay and by ignoring fraud Ebay is actually encouraging fraud.
What really twists my nads though is this guy now has left me with my first neg and he doesn't even have to pay for the Auction/Item! Un-freaking-believeable!

He will pull his auction. This happens occasionally.
Do everything you can to screw his ass. Pull no punches. Take no prisoners.

John Z, There is only 9 hours left in his auction, it will be over before I receive his payment.
I want to add that HE added the BS about the book value of the lot being $3000.00 and that there are coins valued at $17.00 in the lot. That was not in my Auction.

Many less than honest sellers will bid on an item hoping to turn it over for a profit. That's exactly what this person did to you, only he forgot to pay you and collect the item because he probably has about a hundred of these shenanigans going on at the same time. Yours just happened to slip through the cracks.
I've seen dealers on eBay selling items that were up for auction on Yahoo long before the Yahoo auctions were complete, and even utilizing the same pictures.
Like I said, do everything you can to screw him to the wall.

I agree with the general consensus so far....this dude is not playing on the up-and-up. I read his neutrals and negs for this year.
I also looked at the words he added to your auction text.
If you think you want/need the money from the dimes, then you will do what you need to. If the principal of the matter is important....I would NOT allow him the dimes.
And, I wouldn't tell him until after his auction closed.
Would be funny if someone emailed his bidders to let them know the older auction number and the fact he hasn't paid, but i believe ebay would frown on that and attack the wrong person
He must have had pretty big "frankies" to try to complete the auction after a month of no response. Get your ebay fees back. Relist them if you want/need. (was that a mini-hoard from saving for a long time, or did you buy a bunch looking for certain keys/semi-keys?). If mom's eyesight was better, I would be tempted to make an offer for them as she loves Mercs and Kennedys...and, you offered very cheap S&H (he is asking for almost $10 while yours was under $4).
bottomline....my suggestion....screw him! He ripped on you by bidding, winning, then not following through, now he only wants them because he is trying to sell them.
If his auction doesn't close above what he bid on yours, do you think he will follow through still?
Don't stress yourself more on it....get your ebay fees back, let his close, don't be too quick to reply to him, and just tell him he took so long, with no response, they went to someone more deserving (like a politician

PS...sorry for the long post, but reading your post, and looking at the auctions, then his feedback...well, it got me a bit riled up (and they aren't even my coins or my auction!)
I've been told I tolerate fools poorly...that may explain things if I have a problem with you. Current ebay items - Nothing at the moment
Bochiman, that's just it, he hasn't contacted me to let me know that he is still interested in completing the auction. No Emails from him and no payment.

Actually it is from two different estate auctions that I attended, one recently and one about 6 months ago. And as you can see from my auction description although there are some nice coins in the lot, there are no 16D's or 21's.

BTW, I'd suggest adding that clause to your standard terms. Doesn't mean you have to enforce it every time.

Definitely looks like he is trying to 'flip' the auction before he pays you for it. I would ignore him totally, neg him and sell the dimes to someone else!

The fact is he never had posession of the lot as he never paid for them so the "item" was never available for sale "by him". Obviously the bidding never hit his predetermined minimum so he cancelled the auction.
So, how do I get to Ebays' "safeharbor" to report this scammer?
