What the HEY?!!!! What would YOU do? UPDATE

This guy bid on and won my Auction (over a month ago) but he never paid for it.

Now he has copied my auction word for word and is using the pictures from my auction to resell the Mercury Dimes in his Auction.

Yet, he has never paid for nor received these Mercury Dimes from me. He has refused to respond to numerous Emails from myself and Ebay.

Now he apparently is going to complete our auction while at the same time conducting his Auction of what is technically still my lot.

So, should I tell him that, since he never completed the purchase and refused to respond to numerous Emails from myslef and Ebay, I sold the lot and it is no longer available? Then let him have to deal with the winner of his current Auction?

And yes, it may be petty on my part, but I am sick and tired of this type of bidder.

Jim

UPDATE:

Well, I got the response from Ebay, all they did was delete his fraudulent auction. They will not sanction him in any way. So much for Ebays fraud protection, apparently if you are a regular seller your fraudulent acts are ignored by Ebay and by ignoring fraud Ebay is actually encouraging fraud.

What really twists my nads though is this guy now has left me with my first neg and he doesn't even have to pay for the Auction/Item! Un-freaking-believeable!

I would report him to Safeharbor. I would also put in a non-paying bidder and get your fees refunded. You could also place a high bid in the auction knowing you already have the items, but then you would be responsible to pay for it.

He will pull his auction. This happens occasionally.

Do everything you can to screw his ass. Pull no punches. Take no prisoners.

55, I've already filed a "non-paying bidder" and have 3 more days until I can file for a final value fee credit.

John Z, There is only 9 hours left in his auction, it will be over before I receive his payment.

I want to add that HE added the BS about the book value of the lot being $3000.00 and that there are coins valued at $17.00 in the lot. That was not in my Auction.

Yes Jim, I understand. I'll tell you exactly what happened here if you don't mind my verbosity.

Many less than honest sellers will bid on an item hoping to turn it over for a profit. That's exactly what this person did to you, only he forgot to pay you and collect the item because he probably has about a hundred of these shenanigans going on at the same time. Yours just happened to slip through the cracks.

I've seen dealers on eBay selling items that were up for auction on Yahoo long before the Yahoo auctions were complete, and even utilizing the same pictures.

Like I said, do everything you can to screw him to the wall.

    We ARE watching you.

    Nogvmnt,

I agree with the general consensus so far....this dude is not playing on the up-and-up. I read his neutrals and negs for this year.
I also looked at the words he added to your auction text.

If you think you want/need the money from the dimes, then you will do what you need to. If the principal of the matter is important....I would NOT allow him the dimes.
And, I wouldn't tell him until after his auction closed.

Would be funny if someone emailed his bidders to let them know the older auction number and the fact he hasn't paid, but i believe ebay would frown on that and attack the wrong person image

He must have had pretty big "frankies" to try to complete the auction after a month of no response. Get your ebay fees back. Relist them if you want/need. (was that a mini-hoard from saving for a long time, or did you buy a bunch looking for certain keys/semi-keys?). If mom's eyesight was better, I would be tempted to make an offer for them as she loves Mercs and Kennedys...and, you offered very cheap S&H (he is asking for almost $10 while yours was under $4).

bottomline....my suggestion....screw him! He ripped on you by bidding, winning, then not following through, now he only wants them because he is trying to sell them.
If his auction doesn't close above what he bid on yours, do you think he will follow through still?

Don't stress yourself more on it....get your ebay fees back, let his close, don't be too quick to reply to him, and just tell him he took so long, with no response, they went to someone more deserving (like a politician image )

    Ron

PS...sorry for the long post, but reading your post, and looking at the auctions, then his feedback...well, it got me a bit riled up (and they aren't even my coins or my auction!)

I've been told I tolerate fools poorly...that may explain things if I have a problem with you. Current ebay items - Nothing at the moment

"He must have had pretty big "frankies" to try to complete the auction after a month of no response. "

Bochiman, that's just it, he hasn't contacted me to let me know that he is still interested in completing the auction. No Emails from him and no payment.

"was that a mini-hoard from saving for a long time, or did you buy a bunch looking for certain keys/semi-keys?"

Actually it is from two different estate auctions that I attended, one recently and one about 6 months ago. And as you can see from my auction description although there are some nice coins in the lot, there are no 16D's or 21's.

    Jim

PS. No apology necessary, it's good to see that people are so thourough.

Holy s*** that's a lot of mercs. I would by them right now for more than that if I wasn't so damn broke.

I'm not one for posting NEGATIVE feedback at eBay. This character sounds like a real A$$HOLE! Screw'em and the horse he rode in on! Drop a fat negative on him and dump the mercs elsewhere...image

When reporting to SafeHarbor, include that this seller hijacked your auction. False/Fraud etc. Get the idiot bounced.

It doesn't sound like he has tried to pay you yet. If he does I would refuse to respond to his emails. Let him wallow in his own greed. If he uses PeePal just return it. Unfortunately the new bidder may send him payment not knowing that he doesn't have the goods. If there is a way to warn the new bidder without going thru eBay I would try that.

This looks just like an auction a freind of mine had up for auction "Nogymnt", He concurs that you won his auction, did not pay for them yet, copied his auction and now you are trying to sell coins just like those in his pictures.

    Say it is not so!

I want to bid, but I do not want to get involved in any EBAY Scams!

Those aren't the same pictures, btw. But they were taken the same way (same background and spread of coins). I wonder if you can get him for plagarism with the rest though?

E-mail the guy and tell him that there's a 10% late fee after 30 days of non-payment and that the sale will be cancelled after 45 days of non-payment. Give him a chance to pay up. If he won't, then he'll cancel his own auction. If he pays, you were compensated for the hassle.

BTW, I'd suggest adding that clause to your standard terms. Doesn't mean you have to enforce it every time.

You've probably thought of this and it may have been mentioned and I missed it, but make sure to add him to your "Blocked Bidders" list. He is now on mine.
"What are you putting that tape on your nose for?"
    "Exactly."

Hey guys and gals - before this gets completely out-of-hand, as Senlathiel has already pointed out - THOSE ARE NOT THE SAME PICTURES! He has definitely hijacked the text of your auction, but the picture came from someplace else!

I think he deserves a neg for not completing the auction, but let's not burn him at the stake as yet!

Make sure you block this bidder from any of your future auctions.

    Senlathiel and ccrdragon,
Yes it is the same picture. It is the second picture in the first column from MY auction.

    Jim

I did see that the second pic was that same - that is unbelievable. I would just follow-thru with your plans of non-paying bidder, get your fees back and put this behind you.
    SNIKT!
You are doing well, subject 15837. You are a good person.

Ok - missed that one when I was looking.

Definitely looks like he is trying to 'flip' the auction before he pays you for it. I would ignore him totally, neg him and sell the dimes to someone else!

Well, he ended the Auction early for this reason:

"The seller ended this listing early because the item is no longer available for sale. "

The fact is he never had posession of the lot as he never paid for them so the "item" was never available for sale "by him". Obviously the bidding never hit his predetermined minimum so he cancelled the auction.

So, how do I get to Ebays' "safeharbor" to report this scammer?

    Thanks, Jim

You aren't being petty at all. The guy is a ripoff artist. Ebay should be dealing with this situation if they are aware of it.

Look at this guys other auctions. It would seem, that Compucheap (board member )sold him a ton of Kennedies. Wonder if maybe he stole the pics from Compucheap, as well?

I just received an email from the buyer, in answer to my EBAY question to seller. Here it is and I shall keep the original in case anyone thinks that I am making this crap up.

"This auction is for the coins listed. As you can see I have many coins up
listed this week. This was his auction I won but could not pay for at the
time so I re-listed it so I could pay him for his auction. It is not any
type of scam, just I still want to come clean on his auction, but had to
list it in order to do so. We had a police officer recently pass away and
are getting up all the cash we can for his family and I am selling off parts
of my coin collection to do this. Hope you understand and still feel
    confident in bidding. Thanks."

The only way to stop ebayers like this is to ban them from your auctions immediately. If people did this they couldn't exist on ebay.

Yeah, he did. But, since he paid me for the coins he's free to use them if he wants.

    NoGvmnt,

If it's any consolation, he's going to lose his ass on the coins he bought from me. He paid well above current market for most of them.
