Two points I'd like to make here:

    1) In addition to the seller having misrepresented the items and recent selling prices, he had no way of knowing or proving that the high bids would not have been honored - he was the one who chose to end the sales early, due to his not liking the user names of the bidders.

    2) If the seller is telling the truth about

<< <i>One of your so called friends participating in the forum was kind enough to share the information with me and said he would cooperate with ebay as long as his name remains anonymous >>

personally, I have a problem with that. If someone here wants to report a fellow forum member for something, that is their right. But, if they are going to do so, they should be man enough to do it without remaining anonymous.
  • I completely agree with mark on both points!
  • Ditto that here too. Serious lack of stones...

  • The seller is a blowhard. Don't give it any serious thought Marty. I'm sure the mystery bidders were not you, anyway.

The seller should be more concerned about his trying to extort money from you. I would think that that is a lot easier to prove than some eBay rule which has no bearing on real laws.

Besides eBay wouldn't cancel your auctions over speculation. There's too much money for them to lose based on the accusations of one whiney scam artist who was obviously trying to rip off inexperienced collectors.

One last thing: The whiney seller's auction stated that his item was a proof dollar. His coin was clearly not a dollar. I believe that is fraud.
  • It's all about the stones!

Well I don't know if this seller is misinformed or not aware. But he/she misrepresented the item in my opinion and just tried to extort money from someone. All I can say is to anyone who gets involved in any one else's auctions for whatever reason good or bad you might be dealing with someone who reacts entirely differently than you might expect. There may not be a stool pigeon; obviously, we can't believe anything we hear from this eBay-er...

Who is our resident troll? There's been so many forum members getting skewered lately that I lost track of who did what to whom...

I have a question, if commercial webhosts are held responsible for content, does ebay have a responsibility to police this kind of auction? They do have some coin experience. Some time ago, I received this coin newsletter from ebay, and I would guess they have access to qualified coin professionals that could assist in policing listings. Should safe harbor be proactive? Should they at least be required to examine complaints from potential bidders instead of waiting for a buyer to complain?

  • I think the problem lies in the difference between what is unethical and what is illegal. This seller is clearly unethical, however it hasn't been proven yet that what he did was illegal.

I will have to agree with everyone here about this auction trying to deceive new ebay users. In the auction, I see nothing showing the coin is a copy. I see the same thing with the NCM's page. Obverse Reverse They show no copy logo imprimted on the coin. The only one legit is this auction

So, I hope that ebay does what is needed so that this cannot happen again.
  • I agree with Dog97. How could this seller get ANY kind of a response out of Ebay on a weekend? I don't think they can provide a response within 4 days! He's probably searched your auctions to get the number and is running a bluff. Just a means of getting his money back, knowing he no longer will be able to sell that crap on Ebay. As for who notified the seller. We all know there are hundreds of people lurking out there, who are not members. There is no reason for anyone to go accusing anyone. Good luck Marty!

Abrogating the Hobby Protection Act isn't illegal? Interesting that this extortionist admits to the character of his friend (friends?); I guess he thought he could outdo that one in trying to walk just over the edge ... but he slipped and fell.

I believe NCM is over the line too, though with less obvious intent to deceive.

I love how he has one listed as "THE VERY LAST ONE", and then has three listed "AFTER" the last one has sold. A true crook at work.
