    Nope, not a copyright, it has a trademark -- the little TM, which is an issue with the USPTO or state trademark law. Big difference between copyrights and trademarks. You must use your trademark on goods and ads or you can lose it.

    While you don't have to indicate copyright ownership with the © it does allow you to sue for statutory damages, so you do not bear the burden of proving actual damages.

    One of the clowns on eBay who is selling copies of Chain Cent stole my avatar coin and is using it to make his trash look better. There’s nothing you can do.

    Retired dealer and avid collector of U.S. type coins, 19th century presidential campaign medalets and selected medals. In recent years I have been working on a set of British coins - at least one coin from each king or queen who issued pieces that are collectible. I am also collecting at least one coin for each Roman emperor from Julius Caesar to ... ?

    “Legality” isn’t the same thing as eBay’s listing policies.
    Something can be “legal” but at the same time, against eBay policy. And hopefully, “illegal” practices aren’t allowed by eBay policies. eBay isn’t the arbiter of what’s legal.

    You're the lawyer, but if ebay's T&C essentially requires that any uploaded images belong to eBay, that is legal is it not?

    Not what we're talking about here. EBay didn't steal the OPs sticker photo to modify the seller's photo (which arguably could be legal). EBay also doesn't give a crap about illegal activity.

    Try reading the whole thread. Ebay T&C permits any eBay user to use images from the product catalog. It is exactly what we're talking about here. If the T&C requires that you give usage rights, then you have ceded exclusive copyright when you posted it on eBay.

    I even saved random speculators from having to search themselves by posting it on this thread. But people prefer to just speculate.

    Actually, it does as you are agreeing to EBay policies if you use EBay and one of those policies essentially forfeits any copyright that you may hold for items listed on EBay: "When you create listings you give eBay and its customers permission, through our User Agreement, to use your images, videos and product details. Your content may be added to the eBay product catalog, and may be used by other sellers in their eBay listings."

    And EBay specifically limits this to EBay content in that they do not allow use of copyrighted material from manufacturer images or videos, as that can create a copyright issue.

    Also note that most copyright violations are civil matters, criminal copyright actions are specifically limited as provided for in 17 U.S. Code § 506.

    I had forgotten they modified their policy to grant permission to everyone to steal your images. You don't hate eBay as much as you should.

    I interpreted the post to which I replied as indicating that copying the image wasn’t illegal just by virtue of the fact that it was eBay. But that, alone, didn’t/doesn’t determine the legality. For it to be legal, it’s required that the person whose image it is first uses eBay (and thereby subjects himself to their user policies).
