would it not qualify as a counterfeit coin?

    Ask @dcarr himself.....

I was not aware they would fit into a mint capsule but maybe they do.

I have been eyeing that coin from the same seller and picture for over a year. I won an auction once from another seller (https://www.ebay.com/itm/2009-American-Silver-Eagle-DANIEL-CARR-OVERSTRIKE/282587447404?rmvSB=true) but seller refused to ship after I paid due to low bidding price. Till this day, I still need one 2009 proof and refuse to pay over$200 :(

That is one that I over-struck. I did not make or endorse the certificates. Nor do I endorse the use of surplus US Mint packaging. I used to see these on eBay pretty regularly for around $150. But maybe the prices are up some in the last year or so ? It has been about 9-1/2 years since I last made them, so they are widely dispersed by now.

I snagged the same type of coin/holder off Ebay last year for $140.77. It's now in an ANACS 69 HC holder.

There are plenty out there, it pays to be patient.

Of course it fits... overstruck on a mint ASE.

But I believe at least some of his overstrikes spread out a bit when struck. If there is a collar I assume it is slightly larger than the original coin so the coin will fit into it.

That is sometimes the case. But most of the time the host coins are run through a slight upset-mill operation (or similar) to reduce the diameter just enough so that they will fit into a collar of the original diameter for over-striking.
