Reason, the center bar of the S mint mark on the Buffalo nickels is almost horizontal
There is very little curve or bend in the line going from the bottom right to top left
I will check my book when I get home tonight to be sure

The example there shows a very distinct horizontal piece of the ' S ' through the ' D ' about mid height. @kevinj may be correct in this instance.

Yes, it is OMM-002
There are two die states on 1938-D/S OMM-002
The EDS has a nice crisp curve near the top, is much skinnier, about half the height of the D (from the field to the top of the D)
The late die state is much thicker, about 3/4 the height of the D, and appears slightly straighter near the top.
This is the late die state of OMM-002.
Both die states are shown in my Authoritative Reference on Buffalo nickels and The OMM book.

Looks like a '38 D/S to me.The 'S' crossbar from the under 'S' is clearly visible in the close-up image.
