A bit of information about a prior board member

As reported in the Coeur d'Alene Press (www.cdapress.com)
Kevin E. Mitchell was sentenced on six counts of misdemeanor petit theft. He had been charged with felony theft, but the charges were "mediated" to the lesser charge.

Mitchell participated on these boards with the name "CoiNuts" a number of years ago and more recently with the name
"CEOcoinshopcom" from April, 2012 to March, 2014.
He operated as a coin dealer from his shop named CoiNuts in
Coeur d'Alene, Idaho, but also did business online. His step
daughter, Sarah M. Mitchell, was also charged with these crimes and sentenced. The coin shop operated from Nov. 2007 through Feb. 2013, but was closed by police in the summer of 2012 as the result of civil claims.

The claims against these two ran for a number of years without much resolution and in the beginning, charges were not even brought against them. Only after continued victims came forward and an outcry from the public, did prosecutors reopen the cases and charges were brought forward.
Mitchell told the judge that he did millions of dollars in business each year. He blamed his store being closed as the reason these people were not paid.

Victims that testified at the sentencing hearing told of over $200,000 they were cheated out of. Some paid cash to Mitchell for him to buy them gold & silver for investment. Others brought in gold, silver & jewelry to sell & were paid with bad checks. These funds were often older people's life savings, or retirement funds. Many other victims are pursuing civil claims totalling many more thousands.
Mitchell's sentence was 6 mo. jail & 4 years probation!
Sarah's sentence was 240 hrs. community service & 2 years probation!

For those of you that had contact with this man I hope you were not hurt. This information is presented so that others in the future will not be hurt.

I agree although I bet very few criminals actually pay the money back. Most have no way to.

He probably has a cash stash somewhere and will claim bankruptcy. I'd sit in jail for 6 months for $200K.

I predict his cellmate will be Big Bubba, a Hell's Angels biker gang guy who bitterly remembers getting bilked out of $10,000 by a dishonest coin dealer as a teenager. Those are gonna be a loooooong 6 months.

Pity.

It's easy to treat others the way I want to be treated. Many do not live by this code.

On that note, I never dealt with the guy or his step daughter.

I once had a step ladder. I never knew my real ladder.

I hate to hear about these situations.

I hope Law enforcement uncovers some assets and the customers get paid, although i doubt it.

Jail will not be pleasant and court ordered restitution is not usually discharged in bankruptcy. Even if he has a stash, he may just lose it when he tries to spend it.

This is why, even if it's not individually a big deal to 'the authorities',I like reading that people do file, report, claim etc. if enough do the dude may end up with the results he deserves.

I lost some back in the crazy days on eBay, but as only one of MANY who were scammed by a certain individual(and took the time to complain) I got several years of updates on how the individual was progressing through his sentencing, incarceration and probation. I liked the emails.

Restitution will not be discharged in a BK. As for jail, well if you look at that area his time in jail will not be that big of a deal. He could even get work release and only have to spend the night in jail. He needed to be sentenced to a year or more then he would have went to prison and actually been without stuff. I have known some people who have done time in jail and they get to order all kinds of stuff off a canteen list. This will only be a slight hindrance to the guy and his girlfriend.

I agree that it appears to be a good place for criminals. I also agree that the victims will not get back most of what they lost even if his assets were taken. Think of all the precious metals he could have hidden and when he needs something just have a friend sell it for him.

Criminals rarely look out for their future. The money is likely long gone, spent on things like 70 inch TV's, a boat, a couple of motorcycles, etc.

Restitution payments are not dischargeable in a bankruptcy proceeding.

$500k?! I'll do 6 months for... $200k actually sounds dead on. Enough to buy me a house without going into debt.

Hell, let me keep my job (I can work anywhere with an internet connection) and I'll let you lock me in an 8x6 room for 20 hours a day for 6 months for $50k. >>

That sir is what is called a corporate job on salary.

Hubar (work release) here where I live is 12hrs out 12 hrs in 7 days a week so no big deal.
