Has legal action ever been taken against sellers of fake slabs?

I'm not talking about the famous 1989 "rattler" case but rather about the increasingly frequent appearance of current type slabs.

What can be done about this problem?

legally there is little one can do about fake slabs as the seller can say they didn't know and well proving they knew is very hard

not to say the cost of the lawsuit, lawyer fees and such would most likely not make it worth while to go after these people
  • Since most fakes are imported, it would be difficult and costly!

    .
there has been numerous litigations against counterfeiters and sellers of counterfeits but like the drug smuggling, i'm confident only a small percentage sees the inside of a courtroom. the #3 things that can be done is education, education and education. i don't hoard counterfeit coin/currency/token etc images because i can't find anything better to do. those images get somewhat image organized and somewhat shared with many others, enough so that hopefully at the very least "is this a counterfeit" is whispering in the back of a few more minds each day. i also try to be diligent about mentioning that coins aren't the only thing counterfeited and there are plenty of other items being faked that actually have a level of danger about them from their poor production and poor quality control. (yes there have been threads/posts about that here image)

if sellers of fakes have a difficult time selling them, that puts immense pressure on them just like any "business" that can't move merchandise. much easier to educate people about what not to buy that to stop people from making things since it is done globally, unless that is you want to start snuffing people and good luck with that. image

if you want the truth, imvso (in my very strong opinion), the closer you get to the top of crime levels, the more diversified they are thus making it far more difficult to bring down the makers/sellers, against like legal businesses, they have hedges in other products to support the whole. ie multinational conglomerates.

Only education on the part of the collectors, diligence by the entire hobby and constant vigilance - these are the only way to combat the counterfeiting market. It will still flourish because of those who rush headlong into the hobby without help or education. Cheers, RickO

I'd like to see PCGS take the lead and come out with guns a blazing. Making examples of even importers will put the kebash on the rest of them.

Yes, but am not at liberty to say since my testimony and findings, were part of it. Not deliberately. I just happened to open the shop to a collector who happened to have heard about me, who was livid about a certain dealer in Minnesota who was very active in polluting our numismatic society with such.

Depends on what you define as legal action. Could be either criminal or civil. IIRC, the Minnesota dealer was served notice of a civil proceeding by our host.

Legal action was taken in the 2009 tampered Morgan slab case.

Passage of H.R. 1849 would help but GovTrack.us only gives this bill a 6% of passing committee and a 2% chance of passing.
