I was wondering if this wouldn't qualify as a 109...not sure because this coin has a good amount of milling, but also the die defects mentioned for the 109a.

Bill Jones nailed it...too crusty for 40. Not that that's a problem !
My take on the Die State is that the 109 has no defects under the wing, your coin may be intermediate, before the more serious lapping took place.
There was a thread about this variety some time ago I think.
