There are lots of patents on holders, but what you are thinking of is a design patent - not on a process or invention, but on the collection of items that make up the decorative design of an article.
For example, ICG has a patent on their holder, but it covers the "stress relief" item - the indents between the label and the coin holder. That's an invention. Those patents are stronger than the decorative design patent (oh, the old Capitol Plastic's holder has a Dnnn,nnn number embossed in it). Since this isn't an actual PCGS holder, there's no patent violation. As far as I know, NGC doesn't have a design patent on their holder or insert.
You can't patent the name PCGS or NGC. You can copyright materials using those letters - say the label format or hologram could be copyrighted (you see that on several PCGS labels, (C) Collectors Universe). You can trademark something - a mark and class of goods. So you can't trademark the color Pink, but you can trademark Pink fiberglass building insulation.
Copyright and Trademark are weaker than patents.
The problem with all of this is that if it's a loon in a basement (and since I posted where to buy the holders from, I suspect so), then to the trademark or copyright holder it's not worth the $100 to have a Lawyer slap 'em with a Cease and Desist letter. Let alone pursue it further. As the copyright holder they can file DMCA takedown notices against each auction. But that too takes money and time to fight.
It's almost clever. PCGS name on a NGC style holder and insert. Put together in a basement. Where each of the individual parts is legal. So nobody really has an incentive to go after them.
