You have to keep in mind he paid prices for the cards that no one else would pay so that everyone would sell them to him.
If he went to try and re sell them there is ZERO chance he would get his money out of them.

I would think he made somewhere in the $45k range. 50% for attorneys fees and costs, the $52k that was quoted for the cards and you are left with $36,500. Add back some money for what they are worth and he did okay.
It certainly worked out in this example and I would imagine future cases would be easier to win with this as a precedent.
That being said that is a lot of risk to take on to proceed with such a venture.
Still a crazy amount of work and money without any certainty that you would get all the cards you needed.

I read the linked article and in reference to production overuns that TOPPS stated they do, I wonder if these are done for 1 of 1's and 1 of 5's etc. And if those spares are destroyed after X amount of time. Regardless of the feelings toward the current/past examples cited within this thread,one would have to admit if it helps to keep the card companys honest in their actual production numbers, it serves us collectors well in the long run.
