He called and asked me to post. I do not know much else except that he must have sent it early and the guy cancelled the check. He has contacted him via email and the guy has not given indication of returning the card up to this point. THere fore, it is stolen. Keep an eye out for this particular card.

I agree and as I said I am posting this for a friend. He is well known in the hobby but had someone post the card on eBay for him. I agree he should have waited to send the card. I do not have all of the details yet, but from what I was told, the buyer talked him into mailing it early before the echeck cleared. I think he assumed he was safe through PP considering they took the fee and accept checks as funding. I personally only ship after notification of echeck clearing.
I agree totally. I didn't take it personally. I told him I would post it to help out so members would flag it if seen. This seems to be a great place of networking for watchdogs. ')

It's not stolen unless a police report is filed. So tell your friend to file a police report on the incident or nothing "legally" can be done if it pops up again.

Canceling an electronic check is the equivalent of issuing a stop payment on a paper check. If someone does this after taking receipt of merchandise, it is a crime. It is check fraud.
It doesn't matter that Paypal recommended not shipping until the eCheck cleared. The person is required by law to either return the merchandise or pay for it.
You may also want to contact the postmaster in Raritan, NJ and let him/her know of the theft by check and that the merchandise was delivered by the USPS.

Oh... Suggestions and talk of vigilantism by anyone is very silly. This should probably be QUIETLY handled by the authorities.

So the “buyer”, THIEF (PATRICK FORENZA*) actually, wrote back five times conveniently said he had no receipt for supposedly sending the Brett card back,(figures, how convenient), and then blames the seller for lying by saying he never received the card he obviously never sent back….now of course the thief Patrick had no receipt then disconnected his phone number and terminated his E-bay Account only to know doubt create another. Gee whiz, I guess the $500 he stole was worth more than his account and his friends and connections as he must not have to be so willing to change his phone number over. A few local card sellers in his area also told me they already would have never done any business with him from prior dealings!
This kid's playing with fire. Dumb people scamming on eBay. I got burned once along with several other people about 10 years ago. We went after him with the postal inspector and police. Long story short, he ended up in jail and had to pay restitution to all those he ripped off.
With a little research, you should be able to find out the names and phone #s for everybody that lives around him.
Send him a message with all that information, and let him know that, unless he returns your card, you plan to contact everybody on the list to let them know that they live next to a thief.

I'm not a lawyer but I would imagine that would get you in hot water and open yourself up to charges against you.
Sorry your friend has to deal with this, but unfortunately he left himself vulnerable by sending that beautiful card prior to the payment clearing. I know in the rush of the world, we try to cut corners to save time or for convenience, but you have to take the time to do things right or you will eventually suffer losses. Reminds of a time I helped a friend. She is horrible with money and she had to pawn a bunch of grandma's old silver pieces and gold jewelry a few years ago. Since they were heirlooms, I was happy my friend was able to gather up the money before the time-frame to pay off the loan expired. But the pawn shop was not in a great area and she was a little bitty thing and was going via train so I offered to go with her and drive her. She probably had a loan of about $1000 and had to put up like $5,000 worth of valuables. She handed the pawn ticket to a 60 year old worker who was more interested in reading the sports section than assisting. Her stuff was all in a box in the safe. he counted her payment and then plopped the box down on the counter and said goodbye nastily. She picked up the box ready to leave and I stopped her and asked if she was not going to make sure all of her stuff was actually in the box. She asked if that was a smart thing to do, and i replied, "of course!" She started going through it all laying the stuff on the counter, and the old guy comes back, grabs the box and dumps her belongings out on the counter all upset that we didn't trust him. "We've been in business 50 years!", he shouted. I told him, "yes, that's great, but we've only done business with you once and thus, we trust you as much as you trust us. And you must know that the second we leave that pawn shop, we have no recourse if something is missing or damaged." The owner perked up hearing the commotion and came by. He apologized profusely and gave a tongue lashing to the employee. So we then stalled to leave and took a long 10 minutes looking over all her pieces to make sure none got dented from being dumped out like that. The old guy stewed fuming while the owner smirked as he knew exactly what we were doing. Thankfully nothing was damaged and all was there. I shook the owners hand, thanked him for his service and said I hope WE (emphasis on pointing to the owner) would do business again. I still never understand why the old guy got so ticked as it was just good business to check. That would never had offended me if I was in his shoes.
