<< <i>For what it worth I had purchased a sealed box of 5 sets on Ebay for $3700

    Paid immediately.

Guy said he would ship asap. He actually relisted with a 3 day auction at $4200 BIN

When it sold he canceled my sale with some lame excuse about Ebay discount.

We exchanged several messages where he basically said "neg me.........so what"

I notified Ebay security.............raised holy hell........pointed out fraud...............he got booted!!

Yup.....no longer a resistered user. Plus funds are frozen on second sale!!

If he ever gets reinstated I will help him get started with a big large cap NEGATIVE.

1,500 power seller lost it all because he thought he could cheat some unknown buyer out of $500. >>

Good for you, and good for ebay, for this action. I read the original post you did about it and figured you were out of luck (you are) but that he would skate. Glad he didn't skate!

I've been told I tolerate fools poorly...that may explain things if I have a problem with you. Current ebay items - Nothing at the moment

    Yeah..........

I won't get anything but the satisfaction of knowing he didn't get away with it.

I got looking at his prior sales and noted he had been selling 100 coin lots of ASEs.

As wild as silver has been I suspect he had done the same thing before to others.

Sell 100 oz for say $3600...collect money.

    Relist a 3 day BIN for $3900

If BIN gets hit......cancel 1st sale.

If no BIN or price drops deliver to original buyer.

It may have been Ebay security looking back at any prior canceled sales that uncovered the scam.

I would guess Ebay security has had a lot of complaints about failure to deliver on these 5 coin sets.

<< <i>The entire purchase and contract is based on a mint order, if the mint order is not shipped then there is no contract. >>

I will say it AGAIN. Make sure that you understand EXACTLY what you are agreeing to. A mint order shipped but later lost in transit or stolen DOES NOT relieve you of your obligation to deliver as agreed to. At least that is how I would interpret the deals presented here [and the statement quoted]. >>

They laid out the terms on their website in great length, and I don't see where it says if the mint cancels an order you still owe us. But I have no stake in this, only my opinion.

    Linky agreement >>

My comment was to a statement from a poster. Was nothing about an agreement. Statement was if mint doesn't ship then you have no deal. That is true if deal was contingent upon mint filling your order. If mint ships, but coins are lost or stolen are you obligated to complete the deal? I say you are.
